Neighbour reversed out of drive into me. Claiming it was my fault

He reversed at speed, with windows frosted into the side of my car as I drove past.
He is claiming I drove into him.
Insurance is taking ages to sort it, we have paid excess in meantime.
Him and wife are horrible people too Sad

My dad has had this happen to him twice! People reversing really quickly out of driveways with iced up windows and just careering straight into him! Both times they were really apologetic at the time, admitted fault etc. and then changed their tune and tried to blame my dad when insurance got involved. Angry

Your insurance should be listening to you.

and if the neighbour comes round to bully you about it, and it is clearly his fault, then report him to the police for harassment, etc.

I would like to know how he thinks you drove into the back of his car sideways. As another poster says, that's some driving skill!

He will be found at fault, the circumstance is enough without the technicality's which would be considered from the car damage. Which will also demonstrate that you are not at fault.

I pulled out in front of a car once, that had just broken a red light and driving at speed. I was found at fault. The extra details didn't matter, the clear cut thing was, I pulled out.

We were involved in an accident where a car went into the back of us. Both cars written off. First solicitor sorted it in a year. Or so we thought, turned out she'd settled on a no prejudice basis which I believe means other driver admitted no fault! This was despite her going into the back of us.

A full year later we got another claim from the driver, claiming we were changing lanes and she had 2 independent witnesses. This time our solicitor was brilliant and with some detective work proved her 2 witnesses didn't exist and the addresses she had given for them were her relatives.

It felt like a nightmare at the time and was very stressful but the truth did prevail. Good luck!!

The insurance companies will sort it out between them. If the evidence is clear that he reversed into you, you should be fine in the end. It just takes time. When we had an accident that was the other person's fault, it took over three years to get the money sorted out.

Ps the second claim went as far as getting court dates before it was eventually settled.

I had someone drive into the rear offside wheel of my car (he decided to change lanes without checking properly) which then caused me to crash into 2 other cars. An off-duty policeman happened to witness the crash and agreed with my version of events. The police attended and supposedly took notes. I was given a case number so didn't think to get the details of the off-duty policeman. I was too shook up and concerned for the poor drivers I had gone into to check whether they had breathalysed or tested him for drugs (he had been driving erratically beforehand). Didn't think too much of it as it was clear who was at fault and the police had agreed. Later he claimed I had driven into him and the insurers agreed to settle 50:50 (that way they at least claim two excesses). The police when contacted couldn't find the supposed notes. Hmm
I objected and was told if I want to fight it, I would have to go to court. In Nottingham. I live in SE London; the accident took place in SE London. WTH? Our excess wasn't a huge amount and DH didn't think it was a great idea to waste a whole lot of time/more money getting there & back just to prove a point. still rankles
Fight it Op on behalf of the rest of us that have been screwed over by these scumbags/insurance companies! Good luck.

Have you told your insurers?

They normally cough up and repair your car and then claim it back off the other driver.

You can claim the excess back as it’s not your fault - make sure you do this separately.

I council vehicle reversed into my car writing it off in January last year. They are denying responsibility and my insurance are still trying to sort it out. Pissed off doesn’t come close.

Also, point out in your photos about the frosted windows .
It is (AFAIK) illegal to not clear your windows (snow/ice) before driving.

You'd imagine that would be pretty cut and dried. How can you be responsible when you're already on the road and have right away? What a chancer. Get on to your insurance company.

Definitely keep calling your insurance. I had a lorry drive into the back of me whilst I was stationary waiting to join a roundabout. I had photos of the lorry over my lane and where he had gone into the back of me.

The driver was horrible!! My own insurance company kept pushing me to accept a 50:50 fault. They even said I had to admit some fault, as it is my responsibility to be more aware driving around big vehicles!!!!

No bloody way was it my fault at all. I kept pursuing the issue. Thankfully the damage was all cosmetic, so I had to drive around like that for 6 months. The other side finally admitted liability when I asked for their dash cam footage (big national company lorry). I then got the claim sorted and moved insurer at the earliest opportunity. Mine were horrible to deal with despite me not doing anything wrong!!

I had someone reverse into me in a car park, insurance sorted it out asap (shout out to More Than) it really wasn't complicated even though the other driver was being difficult because she wanted to settle privately as she'd already had high premium for previous accidents Hmm

Have any of your neighbours got cctv?

It is getting really difficult as insurers seem to pay out if it is cost effective to do so. Eg someone came into my daughter when she was stationery, photos taken etc etc. Later he said it was her fault. Her insurer paid our £500 or something - basically it they decide it wasn't worth even paying lawyers to look into it. Same on our estate - one man claimed he put his foot down a drain, loss adjuster came out - saw me, saw the drain and then decided just to pay out as that was much cheaper than fighting it.

DH was hit side-on by a car pulling out of a car park the wrong way down a one-way street. Our car was written off (it was old!) and the insurance company went to court. Despite photos of the one way signs in the car park and the street, and a statement from the council that it was one way the other driver's insurance company fought it. They were a no show at court and found liable. It went on for ages...

stick with it, do not engage (except with police if he gets threatening) and let insurers do what you pay for. He'll probably keep lying and may even produce fake witnesses up to the point when he realises that he'll need to go to court. And lying in court gets you jailed, so he won't.

been there with a female driver who really didn't want to tell her husband that she had screwed up.
