Parking across a driveway

Can anyone tell me where I stand legally if I park across the entrance to someone's driveway?

To give some background, my neighbour can't use their driveway. It is too steep, and therefore any vehicle (unless it was a 4x4 type vehicle with a higher ground clearance) would scrape on the bottom. Most other neighbours have adapted their driveways to make them not so steep and therefore useable.

The parking where we live is limited, to compensate for this my neighbour could park across their driveway to create another space, however they refuse to do this.

So I thought, if there comes a time when there's nowhere else to park, perhaps I might park across their driveway.

To clarify, there is a dropped kerb allowing access to the driveway.

I have MintyMabel, but I haven't found anything to say it's illegal.

But you found the bit that says not to do it? Do you regularly ignore the Highway Code if it doesn’t suit what you want to do?

Fieldsofsausages · 21/02/2020 17:30

MintyMabel I have attached the relevant part of the Highway Code. Please can you tell me if it means that parking in front of my neighbour's driveway is legal or illegal?

So according to your own post about the "must not" and "do not", op has given us evidence that parking in front of somebodies property is not illegal, as you mentioned that it was in an earlier post, and is only advisory. Maybe you should also share the evidence that you have that contravenes this document so kindly provided by op. We await your reply with some anticipation....

MintyMabel · 21/02/2020 19:30

as you mentioned that it was in an earlier post

I never said it was illegal.

It is the entrance to a property. Highway Code says Do Not.

But if any driver is going to choose to ignore the Highway Code when it suits, they probably shouldn’t be on the road.

I stand corrected. You never came out and said that it was illegal, just my reading of it, probably when a poster mentions that it isn't illegal, and you reply with wrong, with no other qualifying points or information. So please accept my apology. I, and this community on the whole, are still waiting for the evidence to contravene the image that op put up, mind. Please don't let my misunderstanding of your earlier comments deflect you from your good work of finding legislation in the highway code that contradicts the highway code...

It's an advisory for a reason. Parking across their driveway would not be a danger to, or hinder, anyone. It would not cause any disruption to my neighbours. It is a space on the road that happens to have a dropped kerb leading to a useless driveway.

I’m assuming that you’ve adhered to every part of the Highway Code, at all times? Never briefly stopped on double yellows? Never entered a box junction when your exit wasn’t clear? You always use your indicators? Always stay within the correct speed limit? Always stay a safe distance behind the car in front?

You cannot decide for them whether blocking the access to their property is a problem.

The Highway Code shouldn't be ignored for your own convenience.

I’m assuming that you’ve adhered to every part of the Highway Code, at all times

I have an IAM certification so yeah, I have never deliberately chosen to flout the HC.

Never briefly stopped on double yellows?

Only when using my blue badge where the lines allow it.

Never entered a box junction when your exit wasn’t clear?

Nope. It causes mayhems if you are stuck on it. Why would I.

You always use your indicators?
Of course. Stupid not to.

Always stay within the correct speed limit?
Yep. Couldn't live with myself if I killed someone just to get there seconds quicker. Set my cruise control and it's easy to do.

Always stay a safe distance behind the car in front?

Why would I risk killing my self by not?

MintyMabel · 22/02/2020 00:17

when a poster mentions that it isn't illegal

Seems comprehension is a problem for you.

Fieldsofsausages · 22/02/2020 00:53

Well in that case, I bow to your greater superiority, and I shall spend the rest of my days aiming to get on a horse as high as yours. Goodnight and God bless.
