Can school ask me to collect excluded child straightaway?

I’ve recently been told that it’s against the law for my sons’ schools to tell me to collect him during the day when excluded.
I never thought anything of it at the time, but looking at a government website it says not.
But I’ve had three schools now (2 different sons) ask me to collect them straightaway.
Should I be refusing or not?

Btw, if anyone has some great ideas of how to deal with an undiagnosed demand-avoidant, possibly adhd 14yo being excluded from school more than he’s actually there, I’d love to hear them.

This says more about you and your parenting than about the schools.
an undiagnosed demand-avoidant,
You mean a disobedient and disruptive pain in the neck.

Maybe try to get a diagnosis with school support, as they keep excluding him.

Then get SENDIAS involved in getting him support!

3 schools, 2 sons, how many exclusion events?

Why have you picked these labels out of the air that no clinician has seen fit to diagnose? Excuses, perhaps?

That's such a spiteful thing to say, @74NewStreet. If the OP has a son like this she must be under incredible stress.

They should add the half day from you collecting him to the exclusion. Eg if incident takes place Tuesday and he is excluded for rest of week, and they want you to collect on Tuesday (at any point really), then it should be recorded as 3.5 days

Should I be refusing or not?

What possible reason would there be to refuse? If he's being removed in the middle of the day then it must urgent (e.g. violence or severe disruption).

Obviously it you can only pick him up when you (or someone) can get there, but why would you say no?

Bluntness100 · 16/01/2020 22:09

I also don't understand why you wish to refuse and leave him there. If he's being excluded and sent home something has occurred you need to address with him.

Why do you suspect he has adhd and what have you done in regards to it?

Bluntness100 · 16/01/2020 22:11

Op, it's both your sons being excluded?
