Knocked down by a cyclist

Hello all,
My husband got hit by a bike on a pavements while he was walking out of Tesco Express about three weeks ago. This caused his arm to be relocated with a fracture in his shoulder. Since then, he has pain and he couldn't work (he's self-employed). The incident has been recorded by the police. Anyone's here aware of similar incident, would you think we could claim any compensation? Please advise, thanks, Maria

If you know the identity of the cyclist and they were being negligent in their cycling then you could sue for damages.

NotYourHun · 05/01/2020 16:47

Did he look before he stepped out into a cycle path/the road?

Lulualla · 05/01/2020 16:48

@NotYourHun
He was on the pavement. Maybe learn to read properly.

@NotYourHun op clearly said it was on the pavement.

NeilTheBaby · 05/01/2020 16:51

Bikes shouldn't be on pavements. Did the cyclist stop/ leave details? I'd prosecute

Lockheart · 05/01/2020 16:57

Unless you know the identity of the cyclist then I doubt you can claim anything to be honest.

If you do know the cyclist's identity and you have CCTV from Tesco together with the police report supporting your claim then you might be able to try and claim compensation.

mp389 · 05/01/2020 16:58

We don't know his identity yet, but police has the record. but as insurance is not mandatory for cyclist, would you think we can for damages cost from him?
Do you think we can sue Tesco or city council? Tesco as this happened exactly outside of their door, city council as they own the land?

Sodamncaughtinthemiddle · 05/01/2020 17:00

Why would you think you could sue Tesco or the council? How are they at fault?

MagentaRocks · 05/01/2020 17:01

You want to sue Tesco as it happened outside their door and the council as they own the pavement? Unbelievable. How have they been negligent?

Reluctantbettlynch · 05/01/2020 17:01

Seriously? How the hell are Tesco to blame? Your husband has more liability for looking where he's going than any dreamt up liability of Tesco or the council. You can only try civil action against the cyclist.

Hearhoovesthinkzebras · 05/01/2020 17:01

How can you possibly due Tesco? What did they do to cause harm?

ByAppointmentTo · 05/01/2020 17:02

Why on earth would you sue Tesco or the council? Shock

Crunchymum · 05/01/2020 17:03

The cyclist was bang out of order but are you having a fucking laugh @mp389 ?

You dont seem care who you claim compo from, just as long as you get some???

Go on, make a claim against Tesco Grin

Ellmau · 05/01/2020 17:03

Only the cyclist is liable here.

The only person you could sue is the cyclist. If they have contents insurance they'll have public liability insurance with that.

When you say the police has the record, do you mean they know who the cyclist is? If so, are they prosecuting?

If a crime is committed (he'd have to be found guilty by a Court) you can get CICA compensation. But it would be better if he has insurance of his own so you could sue him directly.

There may be some contributory negligence for not looking properly (depending on the circs).

If the police know the rider's details, approach a no win no fee solicitor for assistance.

LoveNote · 05/01/2020 17:05

jesus!! i had sympathy until the compensation from tesco comment!!

sick of this money grabbing culture

ballsdeep · 05/01/2020 17:05

Why do people think they can claim all the time? Accidents happen. Why on earth is it tesco fault?

Lulualla · 05/01/2020 17:06

Now you're just being ridiculous and siagutsinlgy litigious.
He's been injured. Find. But the cyclist did it; no one else did anything wrong. You want to sue tesco because someone cycled on the pavement? Why dont you sue every other shop he cycled past then? Oh wait... its nothing to do with the shops on the street.

Thirza38 · 05/01/2020 17:07

Please can the OP come and explain how they think they can sue Tesco

Lulualla · 05/01/2020 17:07

*disgustingly

PotteringAlong · 05/01/2020 17:08

It’s not Tesco’s fault! Are the police going to prosecute?

AudacityOfHope · 05/01/2020 17:09

My friend was hit by a cyclist and was told there was no recourse for damages as cyclists don't hold insurance.

mp389 · 05/01/2020 17:10

Please do not judge until you don't know the full story!
We were just told that Tesco may have public liability outside of their premises, as this happened exactly front of their door.
