Maya Forstater: Woman sacked over trans tweets loses tribunal www.bbc.co.uk/news/uk-50858919

ChewChewIsMySpiritAnimal · 19/12/2019 19:31

A woman got fired for her belief that humans can't change sex, and an employment tribunal has said that's fine and dandy and her employer was ok to fire her because her refusal to validate trans identities over her own beliefs offend the dignity of trans people. Jk Rowling stands by the woman who was fired.

Jenala · 19/12/2019 19:32

Short story missing probably most details - a woman called Maya Forstater lost her job for politely discussing on her personal Twitter that she feels sex is immutable - that humans are all either male or female and you can't change sex. She went to an employment tribunal about the loss of her job. She was clear she would use preferred pronouns etc as a courtesy but that her belief regarding sex is sincere and long held and therefore it was not legal to fire her. She lost the tribunal.
I believe she is appealing. It is terrifying that stating a belief that humans can't change sex can lead to being fired. It's ridiculous.

BernadetteRostankowskiWolowitz · 19/12/2019 19:33

It's terrifying to think that I could be fired for thinking this way. I feel as she feels.

peachgreen · 19/12/2019 19:34

She wasn't fired. The company declined to renew her contract. And she wasn't just "politely discussing" things on Twitter.

I'd recommend reading a variety of reports on the case to try and form your own opinion. You won't get an unbiased answer here (and I include myself in that).

ahumanfemale · 19/12/2019 19:47

I'm still waiting for proof - peer reviewed too please - of an XY (male) mutating into an XX (female) of the other way around. At any single point in human history.

It simply hasn't happened and yet stating that is transphobic and will heap a tonne of shite on your head if you state it openly, as we can see with Maya and JK.

delilabell · 19/12/2019 20:06

Thanks everyone! So jk Rowling is saying she thinks she's in the right and the company in the wrong?
@peachgreen what have you read about this /would you reccomend I read?

And just so I have this clear in my head she is stating sex is irreversible but gender can be fluid?

Everything in @Jenala's account is true apart from the losing her job/ renewing contract bit @peachgreen

Maya argued about this online with a person called Gregor Murray who has been suspended as a councillor for his offensive behaviour against women online.

Flamingoose · 19/12/2019 20:21

It's a really confusing story. I feel like there must be a massive piece of the picture missing because it doesnt make sense to me.

On one side: Maya F believes that biological sex is a real thing. She said so. She got fired. It went to court. The judge ruled that her company was right to fire her because believing that biological sex is real is disrespectful to trans people. JKR supports Maya.

On the other side: Apparently she didn't just state her beliefs, she was abusive to trans people and thinks they don;t exist and wishes harm on trans people. But I'm struggling to find the receipts for this side. I wonder if I'm locked in an echo chamber.

Binterested · 19/12/2019 20:26

You’re not wrong “goose”. There was no transphobia. Maya even uses preferred pronouns which I wouldn’t. She just thinks biological sexual is real and matters. I wonder if the original tweets that landed Maya in this shitstorm are still online. Maybe not. Either way she wasn’t abusive - she just believes (knows) something that makes some people sad.

Binterested · 19/12/2019 20:30

Sorry not “goose”. goose. The quote marks were intended for “transphobia” which seems to be like dark matter - impossible to define but everywhere.

SurvivingCBeebies · 19/12/2019 20:42

@delilabell i think that Maya doesn't believe in gender, but she accepts other people may. I'm of the same believe (growing up a total tomboy)

SurvivingCBeebies · 19/12/2019 20:42

*belief

Brahumbug · 19/12/2019 22:14

This is what happens when you start interfering with free speech. I am 100% behind JK.

Thelnebriati · 19/12/2019 22:29

The judgement is here;
drive.google.com/file/d/12P9zf82TicPs2cCxlTnm0TrNFDD8Gaz5/view

Among other things the judge misquoted the Gender Recognition Act. At no point does it state that people who apply for a GRC actually change sex, and they do not acquire all of the rights of their new sex.
