Paternity leave and holidays

DH is due to go on paternity leave at the end of December, I'm likely to be induced around Dec 28th. All employees at DH workplace has 2 days holiday over the Christmas period and he requested Christmas Eve. He hasn't worked Christmas Eve for at least 6 years so this isnt unusual. He has been told he cant have any Christmas holidays because he will be going on paternity leave after. Surely that cant be right?

Honestly, I can understand it. If he hasn't worked Christmas Eve for a while I think it is only fair that others can have this date especially when it looks like he will be off over New Year.

In my line of work having Christmas Eve off happens on a rota, so normally every 4-5 years and as a German it is not easy for me but that's life.

That's not right, you are entitled to your annual leave entitlement + paternity leave. Although the business can determine when you take annual leave so they can refuse leave over Xmas but allow his to take another time in the year.

On what basis can he be refused any annual leave over Christmas but everyone else be allowed it though?

Has been offered an alternative day? Does he automatically get Xmas and Boxing Day? If so, in his shoes I’d ask for 27th and to tag other day on end of pat leave to get more time with baby.

he needs to check his employers leave policies.

most employers will have a section detailing the amount of leave and also a clause along the lines that the timing of leave will be discretionary based on the service / staffing requirements of the company (i.e. keeping the company running).

No alternative day offered. We understand that he cant always have Christmas Eve. If he had been offered 23rd or 27th, we would be disappointed but accept that everyone wants Christmas Eve. He has been told "no annual leave because you will be off on paternity leave". Sitting in hospital waiting for induction on paternity leave is not the same as spending a Christmas holiday day with our 3 year old. Annual leave and paternity leave are separate surely.

I've told him to check the policies tomorrow. But they arent saying he needs to be in to keep the business going but because he will be off later. If he wasnt going on paternity leave, he would have been given the annual leave and the company would presumably have managed

Is he actually losing out on any leave here? Do they get special days that can only be used at xmas or do any days off at xmas come out of the normal holiday entitlement?

As long as he gets to use all his annual leave then unfortunately his employer is allowed to dictate when it's taken. Worth checking the policy on the offchance it guarantees xmas holiday or something but I'd imagine that's unlikely.

Sorry I thought he would still get the days but not as he wanted. He definitely should be able to take annual leave as everyone else, paternity leave is an extra.
