Quick question re employment rights/law

Posting in chat for traffic.

Where I work we don’t get sick pay.

Now the company want to bring in a policy that if you take a sick day, your next shift is docked a percentage of pay.

Considering this is a healthcare setting, going in the a d&v bug isn’t great.

Is this even legal?

I don’t think they could do this because that might make you under the national min wage, which would be against the law. Can you check with Acas?

No, the can't do that. You need to pay people for what they work!

I'd be looking for a new job if I were you - what a way to treat people!!!

Do you have a contract? What does that day about sickness absence?
Do you have HR?

If you are sick do you get ssp?
How much deduction do you get from your next wage following a sick day?

Ultimately I think it will depend on if your permanent contract employee or casual cash in hand?

Contract at the moment states that there is no sick pay. That’s all.

This was from the HR manager. Big meeting yesterday with her and the MD of the company.

It’s a healthcare setting so we pick up bugs. You can’t go in vomiting, it would spread to vulnerable
Patients, so you take the hit and lose a days pay.

Contracted hours, but you clock in and out. So you only get paid the days you clock in and out for.

I was aghast yesterday when they talked about docking your next shift pay if you’d taken a sick day.

It’s a shit, hard no so yes, there are people who take the piss and call in sick If they are burnt out or just can’t face a day. But mostly sick leave is genuine.

One of my colleagues said, “surely that isn’t legal” and the MD said, “if you don’t like it leave. Anyone who has a problem can walk out the door, we can replace you all in a heart beat”.

Awful company. Unfortunately I don’t have a lot of choice at the moment.
