Who knows about how Magistrates Courts work?

If you're summoned to a Magistrates Court for a crime that will automatically be bumped up to Crown Court, do you get the opportunity to put a plea in at that early point? -Or do they only ask you to confirm your name/addresss/DOB etc?

You don’t have to. But with legal advice you should know

AliciaQuays · 12/09/2019 20:38

Your plea will affect if they’re sending off for a trial or sentencing

I wasn't sure if you're actually asked how you plead at this point?

Well If it’s not guilty they’ll send off for a trial.

If it's got to be committed to Crown, then no, you don't put in a plea at the first Mags hearing. An indication of plea can be given, but you are not asked to provide one.

As you have said you have received a summons it must be a summary offence and it will stay at magistrates court.

TwattingDog · 12/09/2019 21:57

@BradTomby not so - it could definitely be something triable either way. I'm not certain about indictable only.

Lots of prosecuting agencies use court summons by means of laying informations at court. Not just the police with the CPS.

Yes you will be able to enter a plea. In 90% of cases advice would be not to at that stage.
