We signed a fixed lease on a house for 2 years in all good faith of fulfilling the term set. The house was a mess when we moved it, very neglected but as it was a good size and good location we decided to hire help with the many deep cleans it needed, pay for a fresh carpet and hire someone to paint the entire house to bring it into a liveable standard and make it feel like home. However, my husband has since been offered a job abroad.

We called and left a message with the agent, three weeks later he comes unannounced and asks me to look around the house and got excited at the work we have had down and how much better it was. We informed the landlord of our need to leave, he wishes to discuss things with us in person . The letting agent told us today that the landlord intends to remarket the property at a much higher price and that we must pay the letting agent all the commission from now until the end of our lease. We will only have completed 6 months out of the 24 month term. On top of our commission they will of course also be receiving the commission from the new tenants who will be paying a higher commission because of the new rental price pushed up by the wor
k we had done.

Do we accept this is what it is, or do we have anything on our side, even if its from a goodwill angle? Any advice appreciated. (It is a house that I imagine will go within a week of being on the market) TIA

What commission do you pay? Is that on top of rent?

I think if they get new tenants then they can’t charge you as well. They could only ask you to continue to pay rent if they couldn’t get new tenants. And it’s the landlord who pays out of your rent - it’s not a separate charge. Look at your lease.

You can't be charged commission, only what rent you owe. (Tenant fee ban). If they find new tenants they can release you from the rest of your tenancy. Check your tenancy agreement for any break clauses.
