Someone I know made a contract with the solicitors that she would give half The money made in their home to her ex husband on the sale of their house, and with a 5% interest that she didn’t pay it.It was signed with the solicitor and her father as a whiteness. The father had bought their house to no mortgage but was allowed to keep what was made.
Well the person (let’s call her sue) didn’t pay, and somehow managed to get away with not paying for it through the solicitor.
She sold it 6 months later and made £30k.
Fast forward 10 years and ex husband has only just found out about the sale of the house (he moved away- he didn’t force a sale because he wanted the kids to be settled).
He’s now contacted solicitor and they have admitted their mistake and have contacted Sue. They have given her 28 days to pay £28k (I think).
She is waiting for it to go court and offering to pay monthly. Even though she lives mortgage free and could easily downsize and make £100k on her property.
What happens next? Will she be allowed to pay monthly? It wouldn’t even touch the interest surely. She says she has no money as it is, and is in £20k debt already. But as said, she has no mortgage and low bills so no idea how.
If it goes court what will they do?
