Cracked bath ... LL or tenant responsible?

Nothing bad has happened to it, only two adults and one child using it...

Small crack noticed as water came through the ceiling.

If it was not caused by you then I'd say the LL as it would be regarded as part of the buildings rather than contents when it comes to insurancr

How old is the bath? If it's old and likely the result of wear and tear I'd say it was the landlord's.

Well we have been here a good few months and it hasn’t leaked before, so we must have done it? But we haven’t done anything bad to the bath, nothing heavy or anything.

The LL had the bathroom done just before we moved in so it’s not an old bath either. Looks cheap though.

LL. It's a fixture. They do crack and wear eventually. You can probably gt something to da temporary fix in it for now.

If it's new get your landlord to get a replacement under the guarantee.

Landlord - plastic baths don't last forever. DH cracked ours getting out of it! He's on the larger side but even so.

Is there a shower over the bath? Some cheap baths are not really strong enough to stand in for showering so might explain why it has cracked. In which case I think the landlord should replace it with one fit for purpose.

Technically, the landlord - it’s a fixture.

However, with it being a new bath and having a child, you may struggle to convince them it hasn’t cracked because said child has been messing about jumping in the bath or thrown a heavy plastic bath toy at it.

Our child is only 4 so would find it hard to break a bath I think, besides which she doesn’t jump around in there.

Well he came over and he reckons it’s a scratch, which maybe it is but it looked like a possible crack to me. So he’s sending a plumber in a few days, he thinks it’s a lose seal.

It’s a bit awkward as we are purchasing the house we rent and will probably complete in a few weeks, but right now it’s still his and we pay rent.....
