Any One Dealt With Court over CMS dispute?

Just looking for some advice. Has anyone been through the process of your cms case going to a tribunal due to disagreements in the amount to be paid? I'm currently about to start this whole process and I'm not sure what to expect, or what the process is? The information I've been provided isnt exactly helpful, so I'm not sure what happens now!

I'm same as you...on the list for tribunal..ex h lying through his teeth on a minute by minute basis!

@Livingthedream12345 I'm exactly the same. Judging by a small piece of info I have been given, they are onto ex-p of mine and know he is lying somewhere. I've been made aware it's a lengthy process and that is fine, but I'm very much in the dark about what is going to happen next!

Absolute waste of time in my opinion. Wait 9 mths for a date. Request forensic accountant and hope you get a good 1. Mine was rubbish, clearly on ex side. Ex turned up without paper work and was given another 3mths, then had 3 male judges who were misogynistic & useless. Ex actually admitted extra £1000s in court :/ but assessment was changed from £7 a week to £16.09. I had what I’d call proof (lifestyle/luxury purchases) the fact ex mortgage was x3 what he was declaring in self employment, but still, he got away with it

@Jaffacakebeast that's what I'm worried about. He pays a laughable weekly amount at the moment, because he is self employed. All his "employees" are family members who get a monthly PAYE (over the odds according to cms) and he doesn't take a pay check each month. God knows what will happen. All I can do is wait it out.

Good luck!! It’s def worth requesting forensics accountant then, but with self employment they seem to be able to get away with 😡
Do a list of all the things that don’t “add up” and insist they question him on all of them

@Jaffacakebeast I will do. He pays hundreds for another child and isn't prepared to budge on this (I would never expect him to either, I just want all the children to be treated fairly) can't really say the reason why as it would be outing. I wasn't aware I could request anyone to look into his accounts. How would I go about this?

I had tribunal booked. I wrote to court asking for guidance on a couple of issues as had tried to get info from CMS - CMS kept fobbing me off saying as it was at tribunal stage nothing to do with them anymore.

Court sent copy of my letter to x as “evidence” - I was asking how I went about getting the arrears of £5k paid as a lump sum as needed it for rent payment and school fees - x cancelled court hearing and although has been paying monthly it has had significant impact on me.

I’ve written to court asking why they sent him a copy of my email - no reply to date.

Personally my experience is they are all fucking useless - I have just had Legal Ombudsman decide that my solicitor needs to reimburse some of my fees - they told me this was legally binding and enforceable - would not answer my questions in advance if solicitor did not pay and told me my behaviour was unacceptable by continually asking questions.

Well guess what solicitor has not paid and LO now seem to be ignoring my emails - it’s an absolute joke!

Sorry to derail but you need the hide of a rhino to deal with these people! Good luck
