Hello there Im hoping someone can help me with this...
I'll try to cut a long story short. Basically I have tenants renting a property that at the start of the tenancy chose what furniture they wanted to stay and what they wanted me to remove. This was done to their satisfaction for the start of the tenancy. A couple of months in they asked if I could remove a piece of furniture to which the letting agent told them she would ask me but they have to understand they took the property on with these items and can't keep moving the goal post. I agreed with what she said but said I accept they may acquire new items as they go along so if existing items can fit in the loft that was no problem, but if not they would have to remain within the property as I had no means of removing them. 10mths on it has come to light that the tenants have removed this piece and another piece of furniture from the property and stored it although covered up and off the ground outside in the covered carport. I'm not too happy with this as I categorically stated this was not to happen as I fear the furniture will get damp and damaged. I said I would arrange for collection and expect the tenants to pick up the cost of £40 to which they have declined! Where do I stand with this? Hmm

You probably only have two options - suck it up or give them a S21 notice. It could be that you could claim the value of the damaged furniture off their deposit when they eventually leave, but that's not a certainty. You can't 'make' them pay the £40.

Hi thanks for your reply.
I've no idea at the moment just how long the furniture has been outside or if it is damaged, I'm awaiting pictures from the agent. Just concerned that the longer it's out there the damage can be caused. The agent did say she had mentioned that if the weather turns they know it will have to come indoors but where to if they don't have the room?
I think £40 is a small price to pay to save it costing them any more in the future. Confused

I would put in writing that they need to take care of the furniture somehow (which could be by paying the £40) and that any damage will be claimed off their deposit. That might nudge them to pay.

I'm not sure why I'm paying agent at the moment they seem to be all for the tenants!

Claim it from the deposit at the end of the tenancy if it is indeed damaged?

TBH if it is covered up, and off the ground and under a car port...it will probably be ok.

I think I will deffo want it in writing that they accept any damage will have to be paid for.
