Ehcp and chosen school

Hi I have requested a statuory assesment for my son and if successful want to name a specific school on the ehcp only problem is it's in another area and won't open till next Sept haven't a clue where I stand with this thanks

When do you think the EHCP will be in place, if it's agreed? And will the proposed school be open this September or Sept 2020? As this Sept will be a bit soon if his EHCP isn't yet in place.

What age is your child? Will he be starting school, transitioning from primary to secondary, or do you want to move him from a school where he is at the moment because they can't/won't meet his needs?

It shouldn't matter if it's in a different area as long as they say they can meet his needs as stated in the application and in his EHCP.

The LA EHCP-admissions team should be able to help even if the EHCP hasn't been granted yet (and once it has, will be much more helpful while you chase it actually being written...)

Hi everyone thanks for replies, it's a free school for high functioning asd there's nothing like this in our area it won't open till Sept, 2020 I don't know if it will be suitable as I'll need to look round and speak to them first my son is in mainstream at the moment and they are ignoring his needs it's not a suitable environment for him at all

If he does get a ehcp there's no guarantee that it will name any specific school, you can ask but generally you would need to prove that a mainstream school cannot meet his needs - with high functioning asd this is not likely. I think you need to try but also be realistic, schools however well intentioned can take time to settle and being in the first intake group is pretty risky. The other thing is that your council make have provision in another school - there's a special unit here in one secondary for instance. We've been right through the system and it's confusing as to what is best but we found support at a mainstream school far better, the asd specific unit was way too disruptive and disturbing for her

Once the needs assessment is completed you will get a draft EHCP and that's your opportunity to name a school in section I. You can ask the LA to consult with a number of schools on your behalf so don't limit yourself to one choice. In fact I would suggest you start looking now. Suitability is the first criteria, if your school of choice is suitable to meet your sons needs and so is the LA choice of school, then the only other way they can dislodge your preference is if your choice is more £ or the presence of your child would effect the education of others already at the school. The LA have to pay regard to section 19 of the Education Act to 'educate in accordance with the wishes of the parent'.

By the way, if your needs assessment is granted then the LA have 20 weeks to complete the ehcp from the time you made the request. If your request is turned down, don't be put it off as most people win when they appeal!
