Child included in promotional flyer

My child had enrolled in a dance class and at the time I had signed an agreement consenting to photography relating to the class. However, she no longer participates in the dance classes and the dance teacher has printed out promotional flyers that contains an image of my child. Am I able to sue her for this as she did not ask for my consent after my child left the class.

Have you name changed op?

Do you remember the wording of the agreement you signed? I’ve just done a quick search and a standard disclaimer seems to be worded as:-

^I grant X the right to take photographs of my child. I authorize X, its assigns, and transferees to copyright, use, and publish the same in print and/or electronically.
I agree that X may use such photographs of my child with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.^

That’s just one of the forms you can get and personalise it for your business. If it’s something like that then it’s pretty clear they can use the photos. Just approach them nicely and ask them to use different photos for their next flyer. No one has to sue anyone.

You come across as someone who is seeing this as a money maker for you.
You consented to photos being taken.
Most people would be proud to see their children on a leaflet like that.

Yeh sue her, bump up her insurance premiums which would bump up the cost of classes, uniforms etc for everyone else.

Jeez just ask her to take the photo down and withdraw your consent 🤦🏼‍♀️

I would definitely read through the agreement you signed again. It really does sound like you are being a bit OTT about this. It's too much of a risk to their business to do a huge promotional drive without previous consent from the parents.

I'd start with the daily mail- perfect the sad face first- with photo of you and your child objecting to local advertising if you and your child- extra points if you have her holding the flyer- then sue for the distress caused by the photo gave consent to have taken, being used. Good luck hun xxx

You are an utter twit. What do you hope to achieve by this - is it some petty revenge at the dance teacher? Please don't enrol your child in any more activities; you were perfectly happy for your child to be in the photo at the time it was taken. Now you want to cause the teacher time and money by withdrawing all of her promo material so that she has to pay to have it all re printed. Go ahead and sue her, and I hope that the dance teacher emails every after school activity in the area forewarning them what they are taking on with you and your child!!
