What can I do, if anything, re clothes order from China?

PoptartPoptart · 07/05/2019 16:08

I recently saw an advertisement on Instagram for a clothes company so I followed the link to their website and saw some really lovely things.
I thought the company was based in the USA as the prices were in dollars (I only later found out that it was a company based in China and the prices were Chinese dollars - my fault I guess for not checking).
I placed an order for five tops and it came to about £80.
When the items arrived they are nothing like the pictures online - they are really bad fake copies of what is shown on the website. The material is poor quality and it looks like it will fall apart after one wash. The sizing is also inaccurate - I checked the size guide on the website before ordering and there is no way the clothes I received are those actual sizes. One of the tops is a completely different colour to what I ordered. There are no labels inside four of the tops - no washing instructions or saying what material it is made from. The one top that does have a label says it is made from polyester but on the website it states this particular top is made from cotton.
I emailed the company to complain and ask for a refund. At first they ignored me and it was only after I sent a third email that they replied asking for photos, which I provided.
After several emails going back and forth they offered me £20 in compensation, or £30 of vouchers for their website (a joke really as I would never order from them again). I said no, I want a full refund and I am happy to return the goods providing they pay the postage (sending the stuff back to China will cost quite a bit I imagine). They refused to pay the postage.
I understand that if I had simply changed my mind and decided I didn't want the stuff anymore then that would be my fault and I should pay the return postage. But the fact is that these items are not fit for purpose. They in no way represent what is showing on their website and I effectively feel I have been scammed.
What legal rights (if any) do I have? I paid on my Mastercard - is it worth contacting them and will they help me? Or, do I have to chalk this up to a bad experience and learn my lesson for next time? I can't really afford to lose £80 but I'm not sure if I have any legal rights on this issue seeing as the company is not UK based.
Any insight or experience gratefully received.

Do a chargeback on your MasterCard. You are covered if you paid by credit card.

PoptartPoptart · 07/05/2019 16:34

@FiremanKing thanks, that’s really useful, I’ll have a proper read.
The only problem might be is that the company haven’t flat out refused me a refund - they have said they will refund my money but only if I pay the return postage costs to China (which probably won’t be worth my while seeing as it will probably cost quite a bit). I also don’t trust them to say they’ve received the returned products either as they’ve said I can’t use a courier or signed for service - just regular untracked postage.

I am always tempted to buy these seemingly beautiful inexpensive clothes that appear but then I remember to check the reviews and lo and behold they're scammers who make it so difficult to claim refunds and returns.

They're everywhere. You have my sympathys

Veterinari · 07/05/2019 16:45

It won’t cost £80 to return a few clothes to China, but i’d Still be sceptical of getting a refund

notatwork · 07/05/2019 16:46

Oh dear. One to chalk up to experience I'm afraid.

I've done similar with one that came up on Facebook for clothes and swore never again but I've done it again recently with a company importing lamps from Turkey. My arse. Receipt came through with a wierd chinese name. So annoyed with myself.

PoptartPoptart · 07/05/2019 16:46

@Bravelurker I know, I’m really cross with myself for being so gullible.
I’ve read so many stories about this sort of thing yet I got sucked in.
Never again!

Is it Wish? Their stuff is really hit and miss and they are terrible at refunds.

PoptartPoptart · 07/05/2019 16:48

@Veterinari I know. I would be even more cross if I pay out for postage to return them and then I still don’t get my refund. Even more out of pocket Angry

Pass on the company name so that we also do not fall foul of this company ?

PoptartPoptart · 07/05/2019 16:52

@Sparklfairy no, it’s a company called Rosefacts.
The clothes look so lovely online but not so much in real life.
I reported the ad to Instagram (where I originally saw it) but I doubt it will make a difference. They are obviously paying to advertise on there.

Yes, unfortunately the pictures they use are usually stolen from instagrammers/bloggers, so are of a legitimate product, but not theirs! There really ought to be some way of cracking down on them, I see tons of tempting looking adverts and if you weren’t used to buying online I can see it would be easy to be fooled.

PoptartPoptart · 07/05/2019 16:54

They also go under the name of Koseme (as well as Rosefacts) online too.
Avoid!

The thing is, I am really cross about wasting the money on clothes that are so hideous (obviously) but I’m also really disappointed as I really like the designs online! I want what they are advertising but sadly there is no way of ordering them.

As much as I always hated to admit that she wad right, my mum always used to say if it seems to good to be true then it is!

PoptartPoptart · 07/05/2019 17:03

They weren’t massively cheap though, average price of £20 per top. If they had been a fiver then I might have questioned it a bit more.
Urgh, I hate feeling so stupid.

The ones I am always tempted with have been selling the most beautiful pair of wedge sandals that I cannot find ANYWHERE. They're on my Pinterest daily and the company is called Berry Brook and I have seen them on She Cici.

The good reviews are fake apparently and I fell down a rabbit hole looking at links to others - all from China and advertising they are from the US.

VanellopeVonSchweetz99 · 07/05/2019 17:14

Increasingly common, happened to me, little or poor response from the merchant (waste of time). I contacted my credit card provider on the phone and queried the charge for 'goods not as described', got a full refund. They will ask when and how you contacted the merchant and I had an email trail to prove I tried but getting a refund was pretty straight forward. Thanks MasterCard. Live and learn Van.

Macandcheese05 · 07/05/2019 20:43

dont suppose you paid paypal? they refund the cost of returns (if you paid via them). up to £15 a year i think. would cover this.

PoptartPoptart · 07/05/2019 20:46

@Macandcheese05 I paid on my MasterCard

Lovlye and Yoins are other companies to watch out for. I returned goods to both. One I got a refund from, the other I didn't! Chalked it up to experience!
