If you can explain the problem?

Inbedbynine · 04/05/2019 06:49

Iv just found out that I haven’t been paid for my break at work for a while. My contract (that is signed by both me and my boss) says my break is paid. She has always said mine is NOT paid and that everyone that started after a certain date is not paid. Well she’s wrong.... I’m leaving my job and I want to work our what they owe me. Legally I’m entitled to that back aren’t I?

Employment law rather than payroll calculations. Hopefully someone will be along to advise.

Good luck!

Oh ok sorry I didn’t realise. I can’t work it out due to the amount of hours I do and paid holiday etc etc

... Ahhh now that part of the question is calculations!

What does contract say about your entitlement to paid breaks?

Inbedbynine · 04/05/2019 07:26

Contract says a paid break of 20 minutes. My boss has told me my break is unpaid. I scanned over my contract of course but don’t remember the finer details and as I had worked there before I trusted them. So I think I’m entitled to that money back?

You need to see your contract. It's not that common to have paid breaks but not unheard of. I do the payroll but nobody gets paid breaks

BillyAndTheSillies · 04/05/2019 07:43

You definitely need to check your contract. I do payroll, some staff are paid breaks based on contract dates and others aren't. But they are hourly paid so easy to breakdown what is owed - if anything.

Inbedbynine · 04/05/2019 07:51

Iv said my contact says ‘with a paid break of 20 minutes’. I have it right here and signed....

What's your hourly rate? Do you work 5 days a week? How many annual leave days do you have per year?

If you're not sure of your hourly rate then there the lots of salary calculators on line that will call it.

Happy to crudely do the maths with the above info.

ree348 would it be ok to PM you?
