Bought a New phone off ebay but it's used

Hi can someone advise,

I bought a "Brand New" phone off ebay, for a fair price.

It arrived today, and the battery shows that it's got 75% capacity left. I checked the IMEI and it's 3 years old! It's in immaculate condition bar some scratches near the charging port. It's definitely used then.

The cf... I've emailed them to ask them to explain themselves...

what shall I do next?

Get a refund from eBay! Do t pay for the postage to send it back. Leave a negative comment.

Open a case for “item not as described”. Then you’ll be able to get a returns label so you’re not out of pocket.

I don't think you should do anything before they reply. Would you be happy to keep it for a part refund for example?

They may have forgotten to change the listing from a previous one, it is easily done, used a sell similar or template and forgotten to change the condition.

Wait to see what they say before opening a dispute, especially if you want to keep it. Give them a chance to put it right before you do anything, it may have been a mistake, especially if you got it for a fair price, ie: not the price it would have been if it had been new.

If they are reasonable and it is a mistake, it is unfair to leave negative feedback. It is horrible when people just jump in and trash your feedback for a mistake that you would rectify if given the chance.

I would log a dispute. I've managed many an iPhone in a professional capacity and wound up with 'spares' that were no use to anyone whatsoever. They were 'free' for me, so you should definitely stand your ground as a paying consumer/buyer.

@chuffnstuff would you not recommend buying a second hand iPhone? I'm looking for one for ds and music magpie and secs seem to do good warranties.

OP paid what they thought was a fair price for a brand new phone, and bought a new phone, not a second hand 3 year old phone

It might still have been a mistake in the listing and is fair to ask the seller and wait for a response before trashing their account. Plenty of time to trash it if it turns out they were trying it on.
