Driving one - pretty sure I was in the wrong

I am almost entirely sure I was in the wrong but interested in your views mnetters!

I was driving up a fairly narrow country lane. It has national speed limit. I was probably going about 30 as it is narrow.

A land rover type car was coming the other way, slightly downhill ifswim, no idea how fast he was going.

As we passed there was a slight crunch and his wing mirror was damaged - though I stupidly didn't check this myself as I was a bit shaken and had kids in the back. Not a scratch on my car.

He was a bit cross though not rude and I said it was my fault, offered to pay or go through insurance. He took my details, said he would send me invoice for the repair. It shouldn't be too much as the wing mirror was still attached.

I probably was going too fast and visibility wasn't great as it's quite twisty. Wish I'd looked at his car but he was checking mine and didn't want to walk away with kids in back seat.

So you saw him, he saw you and neither one of you moved over enough?

FrogFairy · 21/03/2019 16:44

The Highway Code says give way to vehicles coming uphill wherever possible.

Processedpea · 21/03/2019 16:47

did you get his reg and details? pass on to the insurance co to deal with, unless you want to pay his bill

I don't think you're at fault, at worst it's 50/50. Unless you were in the middle of the road maybe.

LittleMissFunTimes · 21/03/2019 16:50

Why on Earth did you say it was your fault??!!!!

Why do you think it was your fault?!

He had as much responsibility to pull over as you did. And in fact should be more used to how much space he needs.

And what PP says about coming up a hill.

If this went through insurers they would agree 50:50 and each see to their own.

Call insurers tell them it was a joint-fault incident and your car has no damage. I guarantee you’ll hear no more

Bobbybobbins · 21/03/2019 16:50

@bloodywhitecat

It happened on the corner so neither of us would have seen the other til the last minute.

Still 50:50

itswinetime · 21/03/2019 16:53

I don't see why you think this was your fault it sounds 50:50 to me maybe more his fault depending on his speed

Shezza71 · 21/03/2019 16:55

I wouldn't inform your insurance company unless you need to make a claim. My daughter was involved in a non fault incident, no damage to her car so no claim, but her insurance still went up as she had been involved in an incident.

My daughter was involved in a non fault incident, no damage to her car so no claim, but her insurance still went up as she had been involved in an incident. If you do hear from him and decide to pay for the damage insist he gets it done at a garage of your choice, pay the bill yourself and keep a copy of the receipt

Bobbybobbins · 21/03/2019 16:59

Thanks for all the points.

I think I said it was my fault as I did feel like I was going a little fast. And it was one of me and two of them (him and wife) both telling me that!

However I guess I am taking his word for it that he wasn't going too fast....

Randomly he said 'I suppose you were rushing to pick the kids up from school'?! (I wasn't)

It sounds like you felt intimidated by him and his wife blaming you.

Tell your insurance company what happened, because it doesn't sound like it was your fault. Perhaps 50:50. Perhaps his! Whose side of the road was everyone one? You were doing the speed limit? He was going downhill? Blind corner? Tell them everything!

ApolloandDaphne · 21/03/2019 17:14

That happened to me once on a very narrow country road. We were both going fairly slowly but just misjudged going past each other. We agreed that we were both at fault and we would just pay for our own repairs.

LordPickle · 21/03/2019 17:19

FML...how is this your fault OP? That's just one of those things that happens and I don't think it was anyone's fault.

Bobbybobbins · 22/03/2019 17:40

Quick update - I got a voicemail from the man today to say his friend had replaced the wing mirror glass for free so all good!

Good ending. He probably thought he had been a bit unfair.
