I work in an office part time Tuesday-Saturday. Other members of team work Mon-Friday.

I do not get bank holiday Mondays in lieu holiday entitlement. Where as Mon-Friday colleagues get 5 (I think/or there abouts) paid Monday's of a year. Meaning that every so often they work a 4 day week but get paid for working 5 days. I'll come in on the Tuesday and work my 5 days as normal.

Is this right? It's not my choice to be off a Monday I've just been allocated those shifts.

So they will work 4 days and get paid for 5 every so often, and I don't even get it added to my holiday entitlement.

@MumUndone, I think it gets a bit trickier if her contract is hours-based.

However, further upthread she says: Sorry including bank holidays I get 23 days they get 28 days in total. and then said, Someone else in my work has same contract and hours but works Mon-Fri. She gets 5 Monday bank holiday.

OP, if that's the case, then there's an argument you're not being treated fairly.

If your contract says Tue-Sat, even if you didn't choose it, you did sign up to it, so I wouldn't make the fact you didn't choose your shifts part of your argument.

I had this same problem when I worked part time. I raised it many times with my managers but I was told that unfortunately that was how the leave was calculated. It seemed totally unfair!

But it does mean if her colleagues were to leave she'd want to go for their job. Which they should be able to see is madness.
And surely she gets below the legal minimum holiday?

The minimum entitlement of annual leave is 5.6 weeks, regardless of how many hours/days you work.

I work 24 hours a week over 4 days, my holiday entitlement is 16 days to take as I wish, and 8 bank holidays.
A 5 day working colleague whether working 40 hours or 16 hours, gets 20 days to take as they wish, plus bank holidays.

Some companies no longer acknowledge bank holidays, therefore you'd have 28 days to take as you wish, if you work 5 days a week.

It's hard for me to explain without waffling on.

If you're having difficulties with your employer tell them to call ACAS for clarification.

Ask HR to show the calculations for your leave entitlement. It should be worked out pro-rata for the actual hours you work.

@StealthPolarBear I think she is yes. If she isn't having 5.6 weeks annual leave, then she's getting less.

Thank you everyone for your input. I've written notes down. My main irk was the fact I do not get bank holidays in lieu.
I'll have raise It in work further up in management and see where it gets me.

It is pickling my brain, and so often I've just been told "we're not doing you out of holidays" but it's just not sitting right with me.

You're entitled to 5.6 weeks including bank holidays. If you work 5 days a week you're entitled to 28 days including bank holidays. You need to take it up with your employers.

The bank holidays are a red herring.

Everyone is entitled to 5.6 weeks of annual leave per year.
