Sick note advice

I became unwell Saturday 23rd feb and returned to work yesterday 4th march. This means I missed 1 x full week at work (Monday to friday) so 5 days. But I see policy states if youre off more than 7 calendar days you need a sick note.
So i missed those 5 plus the 2 weekends either side which means 9 days in total .
But when i called dr they told me to stay in bed, rest, drink fluid etc that it was a virus. So i dont have a sick note. I think I need one though? Can I get one back dated or what should I do?

I don't understand why you need a sicknote here, I think you're overthinking it, unless I'm reading it wrong

You were off work from Monday- Friday. You returned on the Monday. That's 7 days. So you can self certify.

Its 9 because it was 2 weekends as well as the 5 working days. It's my manager telling me thinks I need a note.
So sat, sun, Mon, Tues, wed, Thurs, fri, sat and sunday. Or do people just look at 1 of the weekends? I could have been for and healthy by the last weekend I guess but I wasn't!

Do you usually work Saturdays? As I work Monday -friday, I would count that as 7 days, which you can self certify. I wouldn't count the first weekend

You can self certify for the first 5 working sick days. After that you need a fit note.

So unless you were due to be in work that first weekend then you are covered. The Dr would not backdate the sicknote to when your sickness started. He would date it from when your self cert ended.

I think it’s only if say you went off sick on a wednesday through to the following week that you count the weekends, eg sick Wed-Fri, still sick Mon that would would need a Dr note. Yes you weee sick on the first Saturday, but that’s on your own time.

My company have the same rules and I wouldn't get a sick note for that.

5 working days within a year can be self certified sickness (have you had any other days off in your company year?)

Anything over that I would need a sick note

Bitsurely the 2nd weekend is my own time too?

I mean, I agree I didn't think I needed one but she knows I was sick from the previous saturday so maybe she is including that. She said she will check with HR but i just have a feeling she will be difficult about it.

Pepsilola no i havent but then again i have only been here a month! Blush there was no way I could have gone it though, I had a virus and was comoletely floors plus I'm pregnant so couldnt take anything for it except a measly paracetamol every now and again :(

In your instance it is 5 days self-certified, the only time you account for the weekend is if it’s in the middle of working days you are taking off sick.

Yeh but if i dont include the last weekend that makes it 7. But I guess I do include it because as far as the company knows, I'm sick until I'm back to work even though i dont work weekends.

So i do need one?!

When did you call off sick and again to resume work?

If you called in sick on the Monday, and called on the Friday to resume then that's 5 days. But if you called on the Sunday to resume then that's 7 which is still fine. It's from when you call in to when you call the resume not when you physically return I think.

You don’t need a sick note, (I work in hr) unless you work Saturday, Monday is the first day you have had to call in sick and therefore the first day of your absence as far as work are concerned.

jomalone I didn't call in to resume just came in. Actually came up to the office far away to see my manager and turns out she was on holiday yesterday! So ok if they take it from Monday I'll be fine. I can speak to HR I guess if my manager tells me I need a note.

It's the first weekend that shouldn't be counted as your absence from work only started on the Monday.

At our place, it's from when you reported sick, to when you reported fit.

First 7 days are self certified, but sick note will be required from day 8 onwards.

I work in HR, I wouldn’t expect a fit note for this. I think your manager needs to check with HR, and if says you need one, I’d contact HR direct. You reported sickness on the Monday, returned on the following Monday. I would only count it as 5 days (although your policy does say 7 calendar days), but even if you include the weekend it’s only 7. So either way no note would be required in my view.

If you don't usually work Saturday or Sunday, your absence from work started the Monday so no sick note required.
