Hi I started this 'apprenticeship' at a shop 3.70 per hour found out a week later that the apprenticeship was for customer service level 2 which I already have but the boss had kept me on not on a apprenticeship but still 3.70 per hour then one lad had left and the other was about to be off for 5 weeks for a operation so it was just going to be me doing everything not learning anymore for 3.70 I wanted to leave but the boss is snide he'd tell universal credit I quit so they sanction me but couldn't carry on because of my anxiety about the whole situation now he is being funny and not paying the wages he owes me but there was no contract. Any idea how to get my owed wages?

Surely £3.70 an hour isn't right

I’d go to citizen’s advice. I know apprentice wages are very low, but he can’t keep you on in a “job” that pays £3.70 and blackmail you into staying. That must be illegal.

HMRC ring them they will be very very interested & boss will be in seriously big trouble please read their website about minimum wages

There would have been an education company providing your course to the employer? Maybe you should go to them - 3.70 is shocking but I think standard apprentice wage for under 19 or over 19s doing their first year. How old are you? If you were not an apprentice than 3.70 is illegal.

The situation sounds dodgy as hell and you are better off out. The guy won’t report you because if he is shady he won’t want it backfiring on him.

No contract sounds problematic though. Is there some sort of time sheet/ signing in sheet/ clocking in machine you have used? CCTV? To prove you were there? How long a time span are we talking and what position are you in? Living at home/ supporting yourself? By which I mean if the guy is a dodgy fucker and you are chasing a weeks wages it Could cost you more to chase. But ultimately if you’ve worked it you’ve earned it and the money is yours. You may have to get a solicitor to write to him demanding payment. My dad had to get one to write to my employer (when I was a teenager) and they didn’t pay my overtime.

Would CAB be able to help does anyone know?

Thanks I've kept all emails from him and requested that my wages be paid by morning they was meant to be paid today but I'll try citizens advice and HMRC first thing

This is the correct rate for an apprenticeship:

www.taxguideforstudents.org.uk/volunteering-training/how-are-apprentices-taxed/what-is-the-national-minimum-wage-for-an-apprentice

Do you have a tutor supporting you that you can speak to for advice?

Diddy20161 · 04/03/2019 22:03

I'm 26 I wasn't with the apprentice scheme because I already had the qualification they was offering the only evidence I have is a email telling me when I start work and what time I start and finish even wages so far have been paid in cash so no bank transfers or wage slip

There is no point speaking to HMRC as this is the correct rate - you need to speak to your training provider / tutor for advice. They should have an agreement with your employer. You also need to ask why you have been signed up for an apprenticeship for a qualification you already have?

Diddy20161 · 04/03/2019 22:04

I don't he didn't put me on any apprenticeship scheme
