Ex using his Limited Company to avoid paying Child Support - what are my options?

My lowlife ex has set himself up as a Limited Company and claims to be earning just £10k a year, in order to dodge all his responsibilities. It's clearly bullshit but I assume I'll need proof in order to claim. How can I see the Dividends that a Limited Company pays its only employee? I can't see them on Companies House.

What can I do? Thanks in advance.

He has actually admitted it's unfair and we agreed he'd pay a decent amount, then he discussed it with his wife, and decided not to. He's not earning any less, he's just pretending to earn less. How can I see what he's actually earning, and get a fair amount? He's managed to slash his payments by 3/4. He's a cock.

My ex did/does this so I feel your pain!

Does he pay through the CMS?
If so, first port of call is to challenge the calculation the CMS sends to you. This is a 'variation' and can be done on different things such as your ex have additional income, for example, or that he's hiding his money in the company.

The variation usually fails (each one of mine has) , but then ask for a mandatory reconsideration (which again usually fails) and then you have the option of appealing to a tribunal.

I've won two of these, because the tribunal judge can often take hearsay evidence from you into consideration. The Judge can also ensure the financial investigation unit look into bank accounts your ex has

I don't have much experience of this, but his tax return would show how much income he's drawing by way of salary plus dividends. I don't know whether CSA has that option.

Emma, I know the financial investigation unit scrutinise their finances, they did this with my ex.

MollysLips · 22/01/2019 13:06

Brilliant! I feel a bit more positive.

@Scifi101 -- sorry you're going through this too. Let's absolutely SHAFT them.

@Gems567 - that's really helpful, thanks. I'll happily pursue those steps.

@EmmaStone - can I ask the CMS to look at his tax return?

Molly
Yes definitely pursue it, you'll struggle to get anywhere if you don't I think.

He may have put shares in his new partners name and be paying her a dividend. If that's the case I'm not sure if you can do anything about it.
Look at companies house and got to documents filed and review the confirmation statements and incorporation documents to get as much info on shareholders as possible

Scifi101 · 22/01/2019 15:54

What can you do? If they take the money in dividends and not salary?
