Child support - if I marry my partner, do his payments increase?

Putting this in Chat so it disappears...

My partner is divorced, pays child maintenance to his ex. If we get married, will my income have to be taken into consideration for his payments, so he'll have to pay more...? Or is that a myth?

I can't seem to find a straight answer. Internet says no. But I know someone who says they had to do exactly that.

No it's only his income that is used to calculate payments.

As far as I know, it's only the children's father whose income is taken into account. It certainly is just that in my case anyway.

I'm sure my friend said her income was taken into account on her husband's CSA debt when she married him. Weird.

Hello. I think your income isn’t taken into account when working out the calculation on how much he would have to pay towards his children. However if a person owes backpay to the resident parent the amount csa/cms say he could comfortably afford to pay back each week would be higher as your income would be part of the household income meaning he has more spare money with which to pay back the debt? X

I think maybe quite a few years ago it was factored in, but it's not like that now.
On saying that, I think if you're going to be claiming tax credits for any children/future children, the credits are added on to the maintenance calculation

Many years ago when it was CSA a household income was taken into account. That hasn't been the case for many years now. Refer to the CMO website and the full info is on there.

Also, chat doesn't disappear after 90 days, as stated in the header.

Interesting to know - perhaps it was indeed the CSA debt, and the amount my friend's DH could afford to repay that was the issue there with them being married.

THanks for the heads up about Chat not being removed. Doesn't matter really, just thought it was a frivolous question that doesn't need to hang around for posterity!

It used to be counted when he NRP’s outgoings were taken into account. Only really to stop the ones like my ex who would have happily claimed he was solely responsible for the mortgage and council tax etc despite having a highly paid spouse. It was never the case that the nrp’s wife/husband was expected to contribute to maintenance.

If you have children (or have a child in the future) then I think his maintenance payments would be reduced as he has more children to support.
