My tenancy ends on the 13th February, do I still have to give 28 days notice to leave?

Just that really. My tenancy agreement ends on 13th February and I've found a new flat to move into.

My current letting agent is saying I still have to give the full 28 days notice but surely after the 13th I'm no longer bound by the tenancy agreement as it's expired?

Had I have been staying here I would have moved on to a rolling monthly tenancy agreement but I haven't actually signed anything to say that.

Hi sugar, yes for a fixed term period of 6 months ending on 13th February.

If it doesn't say anything about notice within the fixed term (most agreements do) then you are entitled to leave on the last day. Ask the agent to show you where, in the agreement, it says you have to give notice. Good luck

I am a landline and asked my agency this exact question yesterday. My tenants are on a 6 month contract ending end of February, I hadn't heard if they wanted to continue or not. I asked the agency if technically they could hand the keys back on the end of tenancy date with no notice they said yes they could do just that but it would be unlikely.

Thankfully they have renewed for 12 months.

sugar I would be amazed if they could show me because I can't find it anywhere. The only place it mentions 28 day notice is once I've moved on to a contractual periodic tenancy.

Thanks for the advice everyone. I'll keep you posted on the outcome!

Frankly, given that they're charging me a £150 inventory check out fee I'd rather not have to pay them an additional week's rent if I don't actually have to.
