Can bailiffs take things without warning?

I've come to visit a family member and I always keep my car at their address as I've not long moved out but can't afford to drive my car.

There's a sticker from their Housing Association threatening to take my car in a number of days. My license is addressed here, my bank and I still receive other letters.

Can they do this without even warning me first?

I'm thinking to move my car elsewhere to stop it from happening.

Just want to know if they should have sent a letter to state why I have the debt, not on the sticker btw. So I could sort before this has all happened.

That's why I think it's a threat from the HA. They're not going to seize my vehicle for an unknown debt. That's just strange.

They haven't "vandalised" your car.

There will likely be a number to ring on the sticker, or you can google your local HA's number. Call them to find out what's happening.

It sounds like the Council has checked that a non resident is the registered keeper of the car, so are treating it as abandoned on their property. The sticker is giving you notice and bailiffs don’t just enforce debts. Look up the Refuse Disposal (Amenity) Act 1978 regarding the Council’s power to remove your vehicle.

It sounds like they are moving the car because it has just been left on their land nothing to do with any debt. They have earned this willhappen by putting the sticker on the car.

Don’t just think that; do it or else your car will be towed away and you will have to pay to get it back and ensure it is roadworthy to drive it away from the impound or else pay a tow truck to take it for you.

Why are you assuming it's to do with a debt? I would assume that they want it moved as it's effectively been abandoned on their property. It is not registered to one of their residents so they want it moved.

It isn't for any debt they want you to shift your abandoned car.
If it's parked in residents parking they are within their rights, especially if it's untaxed.
They have notified you, does mum have a drive you can park on?

Of course you can. They're just objecting to you leaving your car there when you don't live there. I read that as them giving you 14 days notice to move the car before they do.

It doesn't say bailiffs it says bailee which is defined as the property holder at the top of the letter.

It says you need to take delivery of goods?

Fuck knows it makes no sense to me.

This is the legislation they are referring to but I've skimmed it and no idea what it's on about

That letter seems to have been written to be as deliberately baffling as possible!

Ring them up and ask them what it's all about.

There are no individual driveways. My mum's lives in a block of flats with shared parking.

I'm going to get my DP to drive it to our place and then register it with the council.

They are telling you to move the car within 14 days or they will take it away and dispose of it for you

Tort law includes negligent acts towards land, so it looks like the HA are acting because of what they see as a car being dumped on their land and have asked the baillifs to remove it.

Is the car registered in your name?

It seems the bailiffs haven't been able to trace you (or name car is registered to). Is there a number on the letter. Call it.

They won't be taking the car without warning as this is the warning.
