Help! Developmental delay and starting nursery

Hello, can anybody help with this?
My son is 3 at the end of January and due to start at nursery at the start of Feb. However on the acceptance letter it stated that they expect all children to be toilet trained prior to starting. My son is not and is clearly not ready either. I have tried and tried but he has no bladder control and just walks around constantly weeing. He is currently seen under a pediatric consultant for global developmental delay and suspected ASD. I really believe nursery would benefit him and that seeing other children will greatly help his development. Can they refuse him? It feels so wrong to be excluded due to being developmentally behind.
Also should add that the consultant has sent a report to the nursery outlining his medical concerns so they should already be aware.

No they can’t refuse him. Even without additional needs many 3 year olds aren’t toilet trained fully
Look at the charity ERIC for advice of toileting and scjool. But they can not discriminate it would be illegal to do so.

Contact nursery when they reopen after chiristmas.

No, they can’t refuse to admit him. He has additional needs and they need to make reasonable adjustments to support him.

Ring them and ask to meet their SENCO to discuss this and other provision they will need to put in place.
