Does getting a solicitor for a speeding offence every work?

Due to various issues including illness I did not reply to a speeding offence to name the driver of my car (which was my husband.) I am not being taken to court.

I am wondering whether it is worth getting a solicitor in these circumstances? Or are they generally just con artists who take advantage?

Solicitors are regulated by the SRA. They can’t just take money off you if you don’t have a chance in hell of winning. But you haven’t given enough information. What exactly is the problem and what outcome are you looking for?

I would instruct a solicitor, tbh.

If it was me I'd ne tempted to try calling them and say you'll accept the fine if you can settle out of court.

Has to be cheaper than Solicitors fees and the increased fine etc. They will save on the court fees win / win.

Thought they just assumed the owner/keeper was driving unless notified differently. What exactly are the court charges? Either phone and explain the circumstances or you’ll end up having to pay the fine and take the points your husband is due.

No, they can’t just assume who is the driver.

There is two different offences:

The speeding offence (husband) and one of failing to identify the driver (S172 RTA 1988) (OP)

At the moment they can’t prosecute for speeding as the driver is inknow (although some forces will libel both charges with one usually being dropped at some point).

I know it’s illegal to take a speeding offence for someone else but assumed it was up to you to notify them you weren’t driving. Thankfully I’ve not needed to be an expert on speeding fines. If you’ve genuinely just forgotten to send off the paperwork phone and speak to someone. It’s in everyone’s best interests to settle this without a court cases. They’ll probably just increase the fine for late paperwork and payment of fine.

Well whoever is taking you to Court I suggest they stay below the speed limit. Speed limits are there to protect people. Respect them.
