Agree what once there are 2-3 left in the top layer, you can start the second layer and put the spares into the gaps.

Fine, but when you dig into the second layer, fill up the gaps with the chocolates that remain on the first layer.

I was going to say that it's absolutely unacceptable, then I saw that it was at work, which I would consider every man/woman for themselves. I have literally no justification for this thought process.
