Redundancy advice needed please.xX

Hello,
Im wanting some advice please.
5 weeks ago i got made redundant from the company that i had worked for,for 4 years,this was due to the company been insolvent,it was a small company..i got redundancy money .however my former boss called me up a few days ago,and told me that he had set up a new company and brand new name,and he was now a sole trader,he ask if i had found a new job,and if not would i be interested in working for him as a self employed administrator..
And as ive not yet found a new job,i accepted his offer..

My question is,would there be any implications on if id have to pay any redundancy money back,additionally how long a gap would i need to leave before returning to work doing a job role that i used to do,but this time it would be working for a company that has a new name,and id be self employed.but working for my former boss. im only trying to earn money for a living,but don't want to have any comeback from HMRC for doing so.
any advice/ help would be greatly appreciated.

Don't think so. Different company and you are now self employed.

Thank you for your advice,i dont suppose you know,if from what you have mentioned,that there wont be any comebacks from HMRC,does that include the 5 weeks from when i got made redundant to now,as i dont know how long i have to wait for it to be a complete break,before i can start work..

Different company so no tax implications but HMRC may have views about whether you are self-employed or employed. Sounds more employed than self-employed to me if its a regular thing where he sets the hours.

To determine if you are self-employed, you need to look up IR35 on HMRC. If they do things like training, team bonding days, paying expenses, etc, you may fall under the category of employee not self-employed.

As people have said it’s not an issue from a redundancy point of view but being self employed isn’t a choice you or your boss can make, it’s about whether you fit the criteria. Check with the HMRC website as there is a questionnaire you can fill out
If it turns out you are actually self employed, which given the info you have put here seems pretty unlikely, you need to register for NI and tax

If you only work for him and he determines all your working conditions/holidays etc, you might not be considered self employed.
