A driving/right of way question

Hurryupbacktoschool · 07/11/2018 20:23

Car A is turning into a side road from a main road. The side road has parked cars all along one side and so only one side can be driven down. Car B is already driving down the side road towards the main road ( and towards the car A.

Should car A:
1- Stop just after they have turned into the road and wait for car B to reach the end, whereby they can both pass and continue on their way.
2- Continue driving down the road towards oncoming car B forcing car B to stop and then have to reverse all the way back down the road?

Which side of the side road is impeded by the parked cars?

Depends where the cars are parked I think. If the obstruction is on your side of the road then the other car has the right of way. If the obstruction was on their side then you had right of way and they should have held back.

1 presuming car b had started their journey down the road before car a made an appearance.

Pascha · 07/11/2018 20:29

Surely if car B is already coming down the road then car A has little choice anyway? Regardless of which side of the road is impeded car B was there first so common courtesy dictates they should have right of way and car A should wait.

OlennasWimple · 07/11/2018 20:29

Who has right of way depends on which side the cars were parked. But if Car B has already begun driving down the road past the parked cars, then Car A should allow them to continue

Were you Car B?

Hurryupbacktoschool · 07/11/2018 20:29

Parked cars are on car B’s side. However when car B started driving there was nothing oncoming and so they were almost at the end. Usually in this situation vehicles turning into the road stop at the top where there is space on both sides. Car B could have then pulled back over and both cars could easily pass.

1, regardless of which side of the road the cars are parked on as B is already proceeding past them.

dementedpixie · 07/11/2018 20:31

If the other car had already started going past the parked cars then the other car should stop and wait for them to come all the way past them

Hurryupbacktoschool · 07/11/2018 20:32

Yes I was in car B. The driver of car A didn’t stop driving and was coming straight at us. We obviously stopped when it became apparent the other driving wasn’t giving way. They then refused to reverse the five foot it would have taken for us to pass them. They insisted we reverse all the way back to the start of the road!

  1. Assuming there is enough room to stop out of the way of the main road.
Pascha · 07/11/2018 20:32

I'm assuming here that you were car B. Car A is obviously an arrogant tit with no patience.

GIVING WAY IF YOU HAVE RIGHT OF WAY

As the driver of the red car with the yellow parked cars on the opposite side of the road, you have right of way. However, if an oncoming vehicle has already committed to the overtaking procedure whilst you are approaching, you must give way. It’s essential during a driving test that you look well ahead whilst before and whilst passing parked cars for this type of situation and be prepared to give way even if it’s your right of way.

If a situation such as this occurs during a driving test and you did not give way, either you or the other vehicle will need to manoeuvre out of the way.If there are no gaps within the parked cars for the blue car to enter, it may require one you needing to reverse to a point in the road where you can pass. This situation certainly isn’t ideal during a driving test and mounting the pavement to allow a vehicle to pass will certainly fail a test.

The key is to observe the parked cars well before you reach them, gently slow the car and look well ahead for oncoming vehicles. Whilst passing the parked cars, look out for gaps in the within thecarsthat are large enough for an oncoming vehicle to pull into. If the road is narrow, be prepared to stop and wait for the oncoming car to pull into the gap and allow you to proceed.

Yes plenty of room to stop. I do it all the time and there’s enough room to stop and let a bin lorry pass.
I actually got out of the car to talk to the other driver ( I was a passenger) as I assumed it was a nervous inexperienced driver who was just dithering a bit. I got a lot of attitude and claims that they couldn’t reverse onto a main road. I tried pointing out they didnt need to reverse out of the road but just a few feet back. They still refused and it got quite heated. We had other cars behind us by now and they would have had us all reverse back rather than reverse slightly themselves.

The term 'right of way' is really misleading and shouldn't be used most of the time. Much better to think of priority. Ignoring the turning, and if car b had not already started along the restricted part of the road, priority would normally be to the car on the unobstructed side. In this case, however, car b has priority because they are already on the side road and travelling past the parked cars. Car a would be a dick to force a confrontation.

Hurryupbacktoschool · 07/11/2018 20:46

Yes, the normal practice is to wait at the top of the road if you see a car turn in or waiting to turn in from the main road. In this case there was nothing there so we proceeded and then the car turned in. Cars always turn in and then stop to allow oncoming vehicles to pass. So I was shocked when this car just kept driving at us. We were about two parked cars from the part where we could have passed them too so it wouldn’t have held them up really. Unlike the inconvenience to us having to reverse all the way to the start of the road.

AnneOfCleavage · 07/11/2018 21:01

So did you have to reverse then? Bit confused as you said "Would have had to reverse back" rather than we did reverse back. Don't see how you and 2 or more cars could all reverse back when he only had 5 metres to reverse. Hate bullies but hope you won in the end as not sure of the actual outcome.

Howhot · 07/11/2018 21:05
  1. Car B had already committed. Car A would be a twat to force their way down regardless of what side of the road the cars where parked on.
Hurryupbacktoschool · 07/11/2018 21:09

No we didn’t in the end as the other driver reluctantly reversed after it got heated and I pointed out the cars now waiting behind us.
Thanks for the replies it’s good to know that I am not a “stupid bitch”.

I had this recently:

The parked cars were all on her side.

She'd just pulled out onto the wrong side as I was already almost at the end of the parked cars (waiting 5s would have seen me past her and she could have moved out).

I still had to come to a complete stop and then wait a minute or two while she came to the conclusion I wasn't going to reverse all the way back for her.

Some people are fuckwits. Try not to sweat it OP.

Hurryupbacktoschool · 07/11/2018 21:22

Some people are just idiots!

Now wondering if you live near me! Turned into road near me at home time today, to find two cars apparently locked in a battle of wills. I thought they'd had an accident at first, so got out, but no - just stubborn. Pretty much exactly the scene you described, except by the time I reached it, both cars had a line of cars behind them (although both lines had sensibly left enough space for one of the stubborn cars to reverse when they came to their senses). In the end, both lines of waiting cars drove down the closest side of the pavement and left them to it I'm afraid. Not exactly ideal driving from us waiting in line, but I genuinely thought we might be there all night otherwise slightly wondering if they're still out there muttering "well I'm not reversing first" Grin

Hurryupbacktoschool · 07/11/2018 21:34

Haha! No not me but had I not been on the way to a hospital appointment it could well have been.
