Are you allowed to carry out a police check on someone without their consent?

Not as far as I am aware! The only thing somebody can do afaik is to make inquiries with the police if somebody is on the sex offenders list if they are in close or regular contact with their DCs. But a general police check no, you would have to give written consent for that.

How on earth have they got your documents to enable them to do the check

How would that even work? You can't ring them up or drop in and ask for a report on someone, no.

No not Claire’s law. They knew all our details (mine and DH) so had no need to ask. The only reason I found out was because they needed a year of birth from SIL and she told me.

Afaik only under Claire's or Sarah's law designed to see if someone may be a risk to a new partner or a risk to children. It would only show domestic violence offences under Claire's law or child abuse offences under Sarah's law.

It’s a member of Dh’s family (by marriage not blood relative) who needs it for a new job.

Have they applied to be a police officer? If so, you have to provide some family details as part of the application in order for them to vet you. Is this what you mean?

Well no, in that case they can't without your permission. I recently had a check done for my new job and had to fill in the form and sign it myself so have they forged your signature?

Dh is a police officer and when we did his application he got permission from the family members concerned to submit their details.

This job is with the prison service (so similar I guess) but our permission has not been requested.

When my DH joined the police he had to put his family details on the application form and you didn't need their permission

I worked in the prison service for years and I also didn't need my family's consent to put their details down on the form.

DH has worked in a police civilian role for almost 20 years. As part of the application process, he needed to supply names / dob / addresses of immediate family - me, parents and siblings I think. I knew he had to do this, but I’m not sure he told his parents and brother. At no stage did the police contact me to inform me that this had been carried out.

Is this a similar situation?

Is it for security clearance? If so, then that doesn't need your consent.

I find it bizarre that such a level of personal information is just allowed to be handed over like that without our permission.

But has a police check been carried out on you? It's likely your names have just been checked against a list of known terrorists or something

I don’t know the level of the check but assume some sort of check has been made otherwise the information wouldn’t have been needed.

Just incredibly surprised, as I said, that this information can just be handed over without consent.
