Is it ok to ask someone if they will admit they are at fault?
They did at the time and were very apologetic, but I just want to check before filling it all out. I d

Oooops.
I don’t want the drama if they deny it was their fault.
They reversed into me by accident, think they thought they were in first.

Aww no. Sad

You can ask but be prepared for them to change their mind having thought about it.

A car went into the back of my friend at a roundabout and he got out all apologetic and said it was his fault etc. Then the next day decided she put the car into reverse and reversed into him. Angry

SpongeBobJudgeyPants · 01/10/2018 19:31

Yes, but there insurance company will advise against it. Take photos on your mobile of the scene and damage.

SpongeBobJudgeyPants · 01/10/2018 19:31

their insurance.

Whodoeswhatwhennow · 01/10/2018 19:33

Well he reversed into my side, so there is no way he can say I went into him.
I should just wait it out really. CCTV would prove it wasn’t my fault.
Only have third party though, so worried if by any chance he gets out of it they will charge me all the fees.

And I would rather a dented car than fees!

Do you have their contact details? You could try and negotiate them paying for your car to be fixed, no insurers involved? Depends how bad it is probably, I did this when someone knocked off my wing mirror.

spugzbunny · 01/10/2018 19:47

There's no way he'd get out of it. If the insurance come back and ask if you'll accept 50:50 or 75:25 etc just keep saying no until you get 100%

Whodoeswhatwhennow · 01/10/2018 19:49

I didn’t think he could get out of it.
Is it a good idea to use Auxillis? My insurer recommended them.

Even with third party only, you need to report the incident to your insurers for their information in case the third party sends allegations. By reporting, you'll also be able to get the third party driver's insurance details and you can claim for your damage directly to them. These days, you can do it all online and attach images etc. The third party insurers will arrange for your repairs and put you in hire while yours is being repaired.

Whodoeswhatwhennow · 01/10/2018 19:50

Or is it best to wait for his insurers to contact me and claim that way?

I had this. They tried blaming me saying I'd shot past the back of them when they were reversing which was bollocks. I was parked. I refused to accept anything and told my insurance to fight it which they did and his paid out finally.

Whodoeswhatwhennow · 01/10/2018 19:51

It’s all reported, just nervous about agreeing to the terms with Auxillis in case it turns into a big who dunnit and I have to pay fees.

OP posts:
Whodoeswhatwhennow · 01/10/2018 19:52

That’s my concern, I was moving past him.

ZeroThirty · 01/10/2018 19:52

Auxilis are fine if you are the non fault driver!! Be careful that they'll stick you in a hire vehicle longer than you need, it only pushes premiums up for everyone else Wink

Whodoeswhatwhennow · 01/10/2018 20:05

I don’t really want a hire vehicle to be honest!

I had someone reverse into me whilst I was just in a parking space in my Tesco supermarket. My engine was running and the car was in netural. He jumped out and said sorry. I had my mum with me and he had his wife. My car received no damage but he had extensive damage to his bumper / back of car. Exchanged details and I phoned my insurance to inform and report no damage to my car. About a month later received a letter ,it claimed I reversed into him. I refused that , and stuck to my original that he drove into me. A few months after they asked to go 50/50, and again I refused ( my insurer even suggested that as I had my claim protected it would be Ok to do. I was pissed off with him trying to pull a fast one so still refused. I never heard any more. I'm convinced his damage was already on his car before.

This happened to me once. I was stationary and parked at the time. Driver got out and admitted his fault. A passing bus driver also stopped, got out of his bus, and gave me his details to contact as a witness if needed. I told all this to the insurer. Subsequently they told me that the other driver had given a different story, saying I had driven into him. And that they had contacted the bus company, who had said it was their policy not to allow their staff to give evidence in road traffic insurance disputes. And that insurers' policy when there is a dispute of this kind is to settle on the basis that if the damage is to the front of your car, then absent any proof to back your story, it is deemed your fault.

They settled it on the basis of it being my fault, I lost my NCB and my premiums went up massively. I was livid. The bastard literally reversed round a corner into the front of my car, while I was sitting in it, parked.

Whodoeswhatwhennow · 02/10/2018 19:14

Massive relief, had a message from his insurers asking to repair my car as he is at fault. Kept the message just in case!
He is with an insurance claim with dreadful reviews, so I agreed with the claims company today as they have great reviews.
Just need to get itall fixed now....

He is with an insurance company with bad reviews that it. I hadn’t even heard of it.
