Few years ago, I rented through an agency and they did not protect the deposit. When our tenancy ended the LL (supported by agency) wanted to take the bulk of our deposit. We argued back and forth for months with agency pretending my deposit was protected and all above board. Eventually I said that they either return my deposit in full or I will pursue the case through the courts and will be requesting the full x3 my deposit back in lieu of their dishonesty. They paid up the next day. I don't know if the LL ever knew that they hadn't protected it.

I'm still waiting for a court date for This now , landlord is trying to take whole deposit , the deposit was never protected for my entire tenancy and then when I threatened to take legal action they put in a deposit scheme after I had already left the property! Had been there over 5 years ! Left over a year ago and nothing on a court date yet .

I had a deposit withheld prior to the new rules. Sent the agent a letter saying pay up into my bank account (details enclosed) by last day of month or we're absolutely going through the Small Claims track of the County Court, and he paid just before the deadline.

We left that place in immaculate condition and had witnesses.

With the new rules, you have even more clout.

Friends of mine did but it was when it first came it. Ll as fucking furious. He travelled a lot and refused to pay it. Do friends threatened an AOE which ll couldn't have because they traveled and had business in the UAE. So paid eventually. Not sure whether judges strictly enforce now or what
