pip claims please help

Hi , first post. Please can anyone help me, my OH has applied for pip and it got turned down first time with 0 points, sent off for the mandatory reconsideration still got 0 points. The dwp has not looked at the further evidence we have sent and we know that the assessor from capita lied on their assessment from what was written in the reply we got sent. We have requested a copy of the assessors report but haven't received it. We will be appealing to go to court but just wondering if anyone else had issues like this.

Hopefully when you get a copy of the report it will shed some light on why he was awarded zero points. It will be easier if you can see exactly what was said, especially if, as you say, the assessor was less than truthful. You can then challenge each inaccuracy. hopefully with reference to your evidence.

I sympathise as the PIP process is a nightmare.

Yes he is male, we know they lied because she said that he told her that he went to a mainstream school (which he did) but at no time in the face to face did he even mention this, there were a few other pointers which was lied about it just makes you wonder what the actual report says. Also been told by the dwp that they don`t send out the reports.

Your local CAB might be able to help you with your appeal to a tribunal.

The Dwp most definitely do send AP reports, I've printed off and sent more than I can count (lowly admin worker). Ring back and ask again, if someone tells you they don't do that, ask to speak to the manager. They do.

Also with appeals it's a short timeframe from recon to appeals. I'm not sure how long you've got as not in work but it isn't long, and you need to send a request to HM courts and tribunals, asap. If you're unsure the person on the phone should be able to advise and if not, have a look online. But really the appeal is very important, perhaps more important than the AP report. After all you'd got the dusalloance letter so can argue the points on there for now - the actual appeal won't be for a while so once you get the ap report you can get evidence to contradict it.

But it's important you request the appeal asap. Good luck

ty very much for your replies. I will try to get him to phone them on monday as his health complaints are depression and anxiety its hard for him to use the phone and get on top of things.

TBH it’s difficult to give an opinion without more detail.

But it might be worth having a look online at the descriptors for his particular disability to see where points might be awardable.

More and more people are reporting that they're being refused access to reports - you most certainly can get them. I don't know why it is but I've seen it on other forums I use as well. Make sure you get your request to appeal in within the timeframe - you can collect evidence after that to submit as far as I'm aware. I've a friend whose been told the wait for them is over a year, where I am it is eighteen months.

Do you have help with the appeal? It's a good idea to get some help with it if you are able (I know not everyone lives somewhere with access to cab or similar).
