Would this not have required an emergency order or something in court?

Melliegrantfirstlady · 05/08/2018 16:55

You are entitled to any information they hold on you. You can apply for it

Is it something specific you need?

You may or may not be entitled to know the location of the children

bellaandshadow89 · 05/08/2018 17:13

Police came and took the chikd away and all i know is that they can hold them for 72hours. There was no information given from any police that were present and the social worker that was there gave one slip of paper with child and parents details on. 101 had to be called so thehycould get the number to speak to someone from social services but because the sw assigned doesnt work weekends nothing will be know until monday.
Does anyone know the procedures of what happens next? Never been through anything like this amd feel totally in the dark. Any help is greatly appreciated

It sounds like the police took them under an emergency protection order. Which means s a judge has been satisfied that the children are suffering or are likely to suffer significant harm. If you haven't been given a copy of the court order you should get one within 48 hours.
I advise you to get a solicitor asap for help with this - you should get legal aid in these circumstances. an emergency protection order should be reviewed everyday so that your children are returned as soon as possible, they last for a max 8 days but can be extended after that.
Have you been given a reason why they took them?

SpecialBond · 05/08/2018 18:28

OP, your posts under the OP name suggest professionals have been concerned for a while. This sounds like an emergency protection order and you will get a copy of the court order.

happybunnymummy · 05/08/2018 19:36

They need to have a court order. If they have not supplied you with a court order with all correct details on then you should have refused them. The court order must have correct names and dates and must be signed by a judge - not stamped from the court. Get a solicitor asap - you should qualify for legal aid.

SpecialBond · 05/08/2018 19:42

The Police would not be involved without a court order (they check all details thoroughly).

So there will be one and if you don't have a copy now, you'll receive one shortly.

MaisyPops · 05/08/2018 19:44

I agree with SpecialBond.
To get an emergency order, there must be serious concerns about a child's immediate welfare and safety. When you add into the mix that you are pregnant and have been trying to keep away from health professionals then that's another warning sign that people will need to keep an eye on the children's welfare.

On Monday go to CAB or see if you qualify for legal aid. Call social services.

Be prepared to work with services. They don't take children lightly.

Pinkgeorge · 05/08/2018 19:53

The court order will have that information

happybunnymummy · 05/08/2018 20:17

Special bond, court orders don't always have the correct information on, I've known of cases where they kept spelling names wrong, they aren't legal unless 100% correct. I've also seen social services plans executed as if they were court orders when they aren't.
They must be correct and the rights of the parents must be protected or they aren't legal.

The only way a child can be taken without your consent or without a court order is by the police exercising their powers under section 46 of the Children Act 1989

So there is no court order. But for the children to be out of your care for any longer there will have to be a court order.

There is more information here childprotectionresource.online/interim-removal-what-does-this-mean-and-how-does-it-happen/

the police should only be taking this action if they are really worried - so its serious. But if the local authority apply for an interim care order or an emergency protection order, you will get free legal help.

The Police would not be involved without a court order (they check all details thoroughly)

This isn't true - well, I hope they check orders carefully but the police do have the power to take children to a place of safety without a court order.

SpecialBond · 06/08/2018 05:22

Sorry, my mistake. Was going on past experience when a court order had the wrong flat number (only one digit) and Police refused to action it.

Spero · 06/08/2018 07:04

It's dangerously confusing - even judges refer to 'police protection orders' and there is no such thing!
