Threatened with debt collectors!!

In 2016 I tried to set up my internet with Sky. After the intial phone call with the sales rep I realised it wasn’t Sky it was a different company (I have since read reviews online that they frequently mislead people into thinking they are Sky and BT).

I cancelled my order via email and received back confirmation that this had been cancelled.

I have now been contacted by text and email saying I Owe them £50 and if I don’t pay this within 30 days they will send debt collectors to get it. I have spoken on the online chat And they are claiming I opted for a priority service to get it installed quicker for an extra £50. I do not remember this and I know I wouldn’t have agreed to pay more for this service.

I asked for evidence and the guy said he could “try” to find a phone record but if I wanted to hear it I would have to pay an additional £10.

I have now emailed their complaints department saying I didn’t order this, they have no evidence that I ordered it. I never received any form of order confirmation/contract and the woman who emailed me back to confirm my order had been cancelled didn’t mention any monies owed.

They have replied saying I ordered it and it was on my order confirmation and they will send debt collectors if not paid. I have replied asking to forward me to order confirmation with the original date and time it was sent (as i have checked my emails and never received this).

Please can anyone advise on what to do?! I am not willing to pay this and the threat of debt collection is stressing me out.

I would do a data subject access request to the company in question and sit tight. The burden of proof is on them and not you and so far they have sent you no documentation to prove you owe the money. If debt collectors turn up simply dong answer the door, they cannot come in unless they are given entry.

I know a little bit about debt collection as I have spoken to one recently for work to collect money we are owed. If it’s a genuine company they would want proof of the debt before they take it on and tbh it would cost more than the £50.00 you allegedly owe. They are just not interested in doing anything without a court order (which we had) Andy for a substantial sum. We were advised to use the court bailiffs who are tons cheaper and that’s after applying for a warrant. So as you have to been taken to court and they are threatening debt collectors I’d guess they are just trying to scare you or don’t use a proper company which I would assume would be illegal anyway. I’m sure someone will be along that knows much more than me. Speak to citizens advice as it sounds like they don’t have a leg to stand on.

The subject access request (request for call recording) used to be £10 where I work. Since GDPR came in it's free of charge so they can't charge you for this any more.

Many thanks everyone. I have googled the debt collection company they are threatening me with and nothing comes up on google for them. I have emailed them asking what ADR company they are with (as I can’t see it listed on the ofcom website) and asking for my recording free of charge due roc GDPR.
