Delivery dilemma

Hi, I ordered some gifts from abroad for DD for christmas back in October, I emailed the company previously as did not arrive by due date. I waited two further weeks and they still hadn't arrived. I contacted them yesterday and the company replied and asked if it hasn't come by next week they would refund. My dilema however is this: my parcel arrived this morning, but after doing the school drop I discovered an email sent in the early hours from the company apologising for it still not arriving and they have actioned a full refund. Do I stay quiet or let them know it has arrived? The parcel was not tracked and DH did not have to sign for it and the cost was almost £50 which at this time of year would come in handy. Advice please.

What's the dilemma? You got a refund for an item that actually arrived and you now have. Email them and send the money back.

Why should the company fund gifts for your dc? Contact them and pay.

It certainly is stealing if you keep the item knowing you haven't paid for it.

No I wouldn't keep the money. I know there are those who believe that its fine to do this sort of thing but it wouldn't sit right with me. You may find they tell you to keep it anyway but no, it would feel like stealing even if it isn't.

It is theft by 'retaining wrongful credit' and carries a custodial sentence. You're required to take 'all reasonable steps' to return money paid to you in error.

Is £50 worth a potential prison sentence?

It is clearly immoral, and technically illegal, to keep both the item and the money.

Only you know if you want to behave like that. I wouldn't.
