Any lawyers? Compensation for broken bone. Liability admitted.

Borntobeamum · 21/09/2021 19:22

I fell and broke a bone.
I have a solicitor who says the other party have accepted liability. My solicitor is frugal with his communication and it’s annoying me!
We took many photos and they know they are at fault.
Im Currently having 6 weeks of physio.
It seems to be dragging on.
Can anyone offer me any idea of when it will be settled or what I may get? X

Really depends, what bone, how did it happen, who is the other party Ie shoo, local authority , individual etc etc,

TheWoleb · 21/09/2021 19:25

I fell and broke a bone on because of an uneven paving stone.
My fault for not looking where I was walking.

Do you really need to sue over this?

TheWoleb · 21/09/2021 19:25

(You've posted in ask me anything so I did)

RNBrie · 21/09/2021 19:27

To get compensation, you have to prove your loss. Have you been unable to work? Have you needed extra childcare? Work out the actual monetary cost to you of the accident and that will be a ball park figure for what you can claim.

VelvetSpoon · 21/09/2021 19:34

No one can give you a value for this at this stage and with such limited information. It will depend on what bone it was, any ongoing or long term effects, and for a fracture it can take a year or more before a medical expert is willing to give a final opinion.

If you're not happy with your solicitor then either ask for someone else in the firm to take over your claim or go to another firm entirely but either way it's unlikely to make much difference to the length of the claims process.

What bone, what were the circumstances? I fell in the tube station and broke my wrist last year but I didn’t occur to me to sue Confused

Borntobeamum · 22/09/2021 07:15

It was my ankle. It also caused tendon and ligament damaged.

The road had been dug up and filled with hardcore however 3 months of traffic driving over it had compacted it resulting in A 2 inch drop. It was on a new housing development who have accepted liability. It happened last year and I’m
Still in discomfort.

You need a medical report. Has your solicitor arranged one?

Hodibiddy · 22/09/2021 07:18

Yes that’s been arranged.

EmeraldRaine · 22/09/2021 07:20

Then you need to wait for that. As someone above said, the level of compo depends on a lot of different factors. Could be £5k, could be tens of thousands. It depends on the specific injury and the prognosis.

TheNatureOfTheCatastrophe · 22/09/2021 07:56

Don't listen to any posters who will pop up insisting that you can only claim for direct financial losses, not pain and inconvenience. For some reason they always crop up on MN, and they're very sure of themselves despite the fact that they don't know what they're talking about.

Hodibiddy · 22/09/2021 09:27

Thank you everyone.
I Appreciate it’s a ‘how long is a piece of string’ query so thank you for reply.
The ankle break has healed well but I’m
Still getting a burning sensation where I damaged the tendon/ligament.
I’m guessing the 6 weeks of Physiotherapy will help with that.

GreenWillow · 26/09/2021 07:58

It’s not just monetary loss, you can claim for pain and distress too.

If nobody ever claimed, there would be no incentive for people (like developers) to spend money to make public areas safe, and more incidents like this will happen.

Hodibiddy · 26/09/2021 15:11

Thank you.
My DH said the form the solicitor sent us for approval had a box ticked for claiming over £10,000.
My MIL had a claim about 30 years after a fall on holiday (hotel admitted liability) and I seem to remember she got around £3,600.
I wasn’t keen on making a claim however I’m still struggling and in pain a lot.

Africa2go · 26/09/2021 15:19

PI claims are notoriously long - they're not settled until the damage / ongoing issues have been properly established even when liability has been admitted. It is likely to be years rather than months.

I don’t think that’s true. I broke my back in an accident 20 years ago when I was a student. So no financial loss. Obviously lots of pain and when the settlement was awarded the main thing seemed to be about future, ongoing pain. An ankle might not sound as bad as a broken back but I’ve also broken my ankle and have far worse, ongoing issues from that than my back. Ankles are notoriously bad once seriously damaged so the possibility of arthritis, possible ankle replacement in the future should be considered.

I’m In So much pain - on my other foot 😔
I’ve been for physio and she says it’s Achilles Tendonitis from over compensating when walking with a limp.
I went In And cried. She didnt know what had happened.
She was lovely and gave me some excercises to help with both feet now.
Feeling really down 😢

Leftbutcameback · 30/09/2021 17:13

That sounds really painful. I have tendonitis in my foot and it's been having around for ages. My doctor says it's poor blood supply to that area and I should use voltarol. Good luck OP. I know from a friend that her claim took an awfully long time so maybe best to just let it take it's course, and concentrate on recovery instead?

Campalumpa · 30/09/2021 17:17

I am nearly 4 years in to an injury claim. iI don't think they get sorted quickly

Hodibiddy · 30/09/2021 19:36

Thank you for your replies.
The claim can take as long as it takes for me. I’m certainly not rushing it.
I’m using Voltarol, and Iceing it. Ive also ordered some resistance bands on the suggestion of my physio.
It seems so unfair that I’m in more pain now than I was originally 😢
