CM Whole process was contaminated by the process used
I accept that
CM Why when concerns of SG and clinicians that CPO cant sanction more work w them cld u challenge finding s of fact
I met all the colleagues. Clear some in SG had concenrs.

AD Many diff views expressed. All interviews done and then I'd take action at that point.
CM p1759: Durrants findings. [reads re diff being objective and fulfil freedom to speak policy]
Yes
CM No-one independent looked at whether shld persist

AD Was told to speak to eq chairs but I then also realised they were also freedom to speak (talked to Galliano). I gave Gx to her re how to move forward and she commissioned Durrant Ix.
J When aware of concerns u spoke to her again
Yes. She said to speak to eq commission chairs

CM After Cs Gx?
AD JG was my chair throughout. I'd had feedback throughout. This has happened - how shld I appraoch this?
CM Do u accept that 2 profess away from work for months
Yes
CM After C reduced her hrs before leaving and Flynn left

CM Yr letter to DSH o p1894/5, u say procedurally flawed. So cld suggest C got off on a technicality
I cant speak to how wld be interpreted. The same language is used for all of the letters, incl Dr Flynn.
CM Do u acceptt the dilution of Durrant findings creates risk of further smears

CM by DSH?
I dont know
CM Detriment 9: p1184/5 emails. Likewise p1187/8. Can u put these on reading list? Both Brown and Davis point to chilling effect to fulfil profess obligations
Yes, I can see their concerns
CM Sept 21, just before Cs interogation by DA. Were Browns concerns?

CM Both are asking for the Ix to stop
AD I dont think they are asking for it to stop
CM [reading] yr being told as an org that this continuation is impeding drs from reporting which concerns patient safety
Yes
CM p1189: Ix concluded evid gathering and wont sanction getting more

BW Thats not approp Q
CM I think it is
J Yr defence was drafted by solics
Yes
J Why does para 7 say this re inaccurate reflection
AD The Cs claim were fully and some partially upheld, so claim of full upholding was wrong

J The vast majority were upheld?
AD Yes
CM p162: para 9. Detriment 11: recom that Ix report is biased and proceedurally flawed
Yes
CM Defences on p141/2 and info on p174/5 u characterise only proceedural flaws and miss out bias and unreliability of report. Why latch onto one

CM procedural and not bias?
Dont know. I said they were unsound to use
CM You never said this
I cant see where said this
CM p196, u say it cant be relied on but only cos of procedural flaws. U dont use language unsound or bias
Yes
CM U do this w DSH

I can feel my blood pressure rising.

I'm not usually a violent person, I don't tend to have the energy!, but I am imagining slapping some sense in to an individual right now.

his laptop has already started its bid for freedom over the edge of the desk.

CM The outcome letter. It's accurately reflected in that para. Text is quoted many times. The C says lifted from Durrant letter

CM He seems to find them dishonest
Yes
CM Plenty of egs, and DAs eg of what's important. The C in WS says DA asked if she was standing down from her role on p1013 [reading fast] But isnt in his summary. You as the commissioner must have been interested in this Q

AD I cant answer that as I wasnt there
CM We have a dishonest investigator
Yes
CM The recording was deleted. Go to p100, following req for audio. [reads email from DA about not being able to provide audio and it being erased once served its purpose]

CM The C says is her data. The LEAs identity was willheld until last month

The hearing has already started
J Let's crack on. Can you forward it to me
CM Detriment 8 - continued refusal to provide a copy of the recording. The passage in DA interview - p62 of witness bundle - should be 1076 and discussion w Michael

CM DA misled the C by saying had met Mr Brown when he hadn't. Re Dr Flynn and DA's account of this - p1069 - [reads re not following processes wasnt true] If we look at what's provided by witness notes by DA, his summary describes as a convo. His records on p1451,
AD I cant say no

I've been thinking a lot about people in authority like Doyle and his attitude remind me of permissive parents of a certain type:

It's all fine to let little Jimmy watch adult rated films in the sitting room of your friends with their kids as you can drink another bottle of that lovely St Julien claret in the Aga warmed kitchen with the adults. It's convenient as you can chat about your Very Important Career without being disturbed.
These weekly kitchen sups (a bit of sick came up just typing that) are wonderful and the kids get on marvellously. You smile benignly when little Jimmy interrupts your friend, who's just plucked up the courage to tell you she needs a biopsy, and watch your boy do some shit forward rolls and 'stunts' to the audience. You congratulate yourself on bringing up a child who's so confident with adults and fits in with your 'continental' social life.

When Tabitha comes to tell her parents that little Jimmy has pinned her down and hacked all her hair off you say it must be an accident and give your tearful son a cuddle before sending him off to play in the other room. The pet dog, whose tail Jimmy purposefully stamped on, was just an unfortunate victim of his 'child-led exploration'. You believe your boy when he says any adult telling him off is just picking on him because he's just brighter/inquisitive/more energetic and special than the other kids.

Besides, you're a bit knackered and life is easier when you don't have to do the work of being accountable and rein in your son's behaviour. Also, now Jimmy's going through a growth spurt, you're secretly a bit scared of him so don't want to rock the boat.

I suppose it's quite likely that today will begin with legal wrangling over AD's diary, so we may be waiting a while?

Add in a different clerk who appears to have no knowledge of the case or the fact there would be lots of observers, we may not get to watch much!

Currently back to WFTCHTJ

We will shortly be reporting the first morning session of day 6 of evidence of Redvers v NHS Sussex Integrated Care Board & Mr Adam Doyle at Croydon Employment Tribunal. Mr Doyle remains on the witness stand and we are due to resume at 10am. t.co/N6CSEtmdEY

Dr Redvers, a named GP safeguarding lead, has a constructive dismissal case. Clinical concerns were raised about a specific doctor at WellBN, a Brighton GP practice. She claims that as a result of escalating those claims from 2020 onwards, she was constructively dismissed.

Her legal claim is discrimination on the grounds of her employer’s perception she had gender critical beliefs and on the grounds of her protected belief in evidence-based medicine (EBM). The respondent defends the latter claim by pleading that EBM is just an opinion.
