If the law is contradictory, which it is, that will need to be resolved. There is a conflict here, and there are provisions within the law for totally excluding males (and females) as an occupational requirement.

hackmum · 18/12/2018 08:38

justicewomen - I think you're right. I think Morton is misrepresenting the law.

Ereshkigal · 18/12/2018 08:38

James Morton concedes that maybe it’s okay “if you’ve suffered trauma...”

Fuck off with your internalised distaste and dislike of everything female, James.

Ereshkigal · 18/12/2018 08:36

If I was an NHS hiring manager, the woolly nature of how these two laws interact and the potential to be sued either way would mean that I would try and steer well clear of hiring any trans HCPs.
And that’s not right.

I agree. I think women would also have a case. And no I agree that they shouldn't be discriminated against for working in a certain area. But there has to be some way to protect women's rights to privacy and dignity.

Ereshkigal · 18/12/2018 08:33

And if, as a transwoman, they suddenly decided that they'd like to start undertaking such tests, that'd be a big red flag for me.

This.

Absolutely this.

andyoldlabour · 18/12/2018 08:29

@BigFarmer,

There are men like myself who are really angered by this whole disgusting situation, but what you and some people fail to realise, is that many "woke" women, deluded, stupid, lefty, "cool" people are also pushing this horrible agenda.
Just look at the Labour party or the SNP or the Lib Dems, to see the numbers of men and women who are supporting transgender rights over women's rights.

justicewomen · 18/12/2018 08:13

I am not sure that James Morton is legally correct. Look at section 22(4)(j) of the GRA. It allows disclosure is not an offence if "the disclosure is in accordance with any provision of, or made by virtue of, an enactment other than this section." Wouldn't that mean to allow for the section 27 of schedule 3 Equality Act (single sex services) provisions to take effect?

Melanippe · 18/12/2018 08:09

FYI, James Morton is a transman who may require cervical screening themselves.

So kind of James to recognise that women with traumatic histories would have difficulties with their policy, not so kind of them not to see that this will affect the number of women who access these services.

This is just another example of women's needs being trampled over in service of men's wants, Plus ca change &c

ChristmasWrappingTheWaitresses · 18/12/2018 08:02

James Morton is a trans man.

So disappointed in these females who have rejected being women. They seem to abandon us with disgust much as many gay men do.

heresyandwitchcraft · 18/12/2018 08:01

PlectrumElectrum · 18/12/2018 07:55

You'd like to think that any HCP would have empathy with their patients and recognise themselves that this could be a problem.

And failing to see this is in itself a bloody good reason they should not be anywhere near women for the purpose of providing any intimate health care treatment/screening.

You'd like to think that any HCP would have empathy with their patients and recognise themselves that this could be a problem.

Presumably a male HCP won't have had much, if any, experience of performing cervical screening as a man, so it's not as though they'd suddenly be stopped from doing it if they transition. And if, as a transwoman, they suddenly decided that they'd like to start undertaking such tests, that'd be a big red flag for me.

LemonJello · 18/12/2018 07:41

Unless the practitioner consented, to exclude them from carrying out female-only care would be a breach of section 22 of the Gender Recognition Act 2004, and a criminal office

The language here is fucking awful.

“to exclude them from carrying out female-only care”

Procedures such as cervical screening are for the benefit and wellbeing of the patient. Their purpose is not to provide an “inclusive” environment for NHS Lothian staff Angry

LemonJello · 18/12/2018 07:36

This sums it up for me.
Fuck women’s rights, which are enshrined in Law, trans rights are more important than women’s. And they wonder why we’re angry!

DisrespectfulAdultFemale · 18/12/2018 07:30

Well put, everyone.

Fuck off, James Morton, and take your woke-bro bullshit with you.

heresyandwitchcraft · 18/12/2018 07:05

Thanks to the Times for highlighting this issue, and to you for sharing. What a travesty that females cannot have guaranteed female-only healthcare. James Morton concedes that maybe it’s okay “if you’ve suffered trauma...”
NO! ENOUGH of this bollocks!
Same-sex, female-only provision is a basic right. I do not give a damn about practitioner feelings. Not same-gender. If you do not know what sex means, and that you cannot change sex, then frankly you have no business being a HCP because you’ve failed basic biology.

LittleLebowski · 18/12/2018 06:16

Thanks for the share Badger. Really boils my piss. I want to be informed if my HCP isn't female and have the right to choose one that is. My body, my boundaries, my choice. Sick of this creep in every aspect of women-only space and service provision just to affirm the feelings of a tiny number of men.

BigFarmer · 18/12/2018 06:14

Well congratulations to men, they managed to make women saying "no" a criminal offence.

James Morton, manager of Scottish Trans Alliance, said he recognised that trauma from sexual abuse could mean some individuals required intimate examinations to be carried out by women who were not transgender.

But completely fails to recognise that all women have the right to privacy, dignity & safety, irrespective of their history. So very focused on trans right to privacy & so spectacularly fails to account for anyone else's right to the same.

It also appears STA lied to the census committee last week when they said that a vulnerable person who employs carers would not be put in a position to justify requesting female only carers & yet that's exactly what James Morton is suggesting when they said:

all patients have the right to choose the particular healthcare professional that provides their smear test. This could be done by booking their smear test with a named nurse or GP they know and trust. Alternatively, they could inform the NHS that they require the person not to be transgender and the NHS could then discreetly arrange for a healthcare professional who is known not to be trans to do the smear test.”

That's an awful lot of effort being put onto women to get female only healthcare when asking for female only health care should be the way to access female only healthcare without any further qualification or explanation.

Wow, that's big of him. Hmm
