AIBU to be absolutely devastated by this?

Posting here for traffic and because I am desperate for someone to talk me down off the ledge!

We own a flat in an expensive part of England. We paid £275k for it back in 2020, it came with a £1900 annual management fee. We thought ah, not so bad, it’s a city centre flat in a new development. In 4 years it’s gone up to £3600. The services received are crap. Over £50k for ‘gardeners’ who come once a year to mow the communal lawn. Cleaners who clock in on the sheet then leave 10 minutes later having done nothing. A scummy company basically, con artists and of course they’re totally unregulated.

We were unluckily caught up in the cladding scandal, and the whole saga of having this rectified took nearly 4 years in total. We moved out over 2 years ago and relocated for career changes, and have been living in a tiny 1 bedroom flat ever since. We couldn’t sell due to the lack of fire safety so have had to rent. We got the fire safety certificate and thought great, now we can sell our flat and move on with our lives! Now we can start trying for a baby (I’m 31, time isn’t on my side).

The flat has been on the market for 6 weeks and not a single viewing or enquiry. We’ve already priced it 25k below market value. Our agent believes it’s the high service charge putting people off.

After 2 years of hell waiting for the certificate and constant pushbacks by the housing developer for non existent reasons, we’ve today been told that our 2025 service charge will be between £7-9k PER FLAT to cover the cost of a new building safety report for all buildings over 18m high. There’s no guarantee this is a one off payment either. If people don’t want to buy with a £3600 service charge, they aren’t going to touch a flat with a £7-9k service charge.

I am absolutely devastated and have been crying since we found out. We thought this hell was over. Our lives have been stalled for over 2 years already. We can’t afford this charge. We are looking at a potential £700+ addition on top of our mortgage. We have tenants in at the moment but their rent only covers the mortgage and the service charge. We never have and never will make any profit off the flat, we rented it out of desperation and because we needed to relocate.

We are now looking at selling it at auction with a reserve price of £230k. We have an £80k deposit in this property and £180k left on the mortgage, so we would be selling at a major loss but at this point it seems the best option. We’ve even stooped to contacting those house buying companies.

I know it sounds dramatic but it genuinely feels like our life is over. We are just normal people with normal salaries. This will financially ruin us 😭

Can only send you this OP 💐
it is very unfair and I feel your pain

Haveyouseenthischicken · 16/11/2024 00:21

@nfkl thank you ♥️

This sounds so stressful. Have you looked into Right to Manage to get the management company out? I'd imagine a lot of other people in the block are feeling the same way right now so it might be a good time to try.

StormingNorman · 16/11/2024 00:23

Not dramatic at all. This is having a huge impact on your life and it’s understandable you are worried and frustrated. The auction sounds like a good idea x

healthybychristmas · 16/11/2024 00:23

That sounds horrendous. Have you spoken to the other owners? I really want to move from my house to an apartment but that service charge issue is what frightens me the most. There surely must be way of objecting.

Nobody will want to be paying that amount. You are obviously all being fiddled over this. Can't you all get together to object?

Takenoprisoner · 16/11/2024 00:25

Not dramatic at all. This is grossly unfair, I don't how this can be legal in this day and age. Seems completely unregulated.

My neighbour had similar issues and sold her flat in a block of flats. Really hope you manage to sell at a decent price and manage to move on with your lives.

Haveyouseenthischicken · 16/11/2024 00:25

@Wibblywobblybobbly I believe someone in our block is currently looking into it, but it’s just another unbelievably stressful process to go through on top of everything else 😭 the issue is leasehold management companies are totally unregulated and they can essentially charge what they want. I believe there’s petitions to have this changed but it feels like they’re trying to take us for all we have before they become illegal. It’s a living nightmare x

Sounds awful. I would contact Shelter and see what your rights are regarding the charges.

Haveyouseenthischicken · 16/11/2024 00:27

@healthybychristmas the other owners are just as devastated but it’s one of those backed into a corner things. If we don’t pay, they threaten with house repossession as it’s a term of your mortgage to pay it.

Another issue is it’s going to be impossible to sell to buyers who need a mortgage as banks tend to only lend on properties where the service charge is only 1% of the property value! In effect, it’s making our property unmortgageable :(

@username358 thank you, I hadn’t even thought of Shelter!

Dreadful. I’m so sorry, op.

healthybychristmas · 16/11/2024 00:28

It sounds too so the organisation is acting in a criminal way.

Would it be worth asking a solicitor?

PeloMom · 16/11/2024 00:29

Sounds awful. And yes, the service charges as are, are quite high. I pay less than 2/3rd that for a one bed in zone 2 London. The highest charge I saw when viewing was around £5k and that was because the building had an old swimming pool that had needed major repairs the prior year.

Haveyouseenthischicken · 16/11/2024 00:29

@healthybychristmas weve considered solicitors but it’s so intimidating going against them. If we lose, we are liable for all of their fees too, and they know this. They bank on people not challenging it because it’s such a costly and long process.

I'm so sorry this is happening to you and somewhere someone is unfairly benefiting from hard working people. I'd be crying and annoyed about too.

ElsaLion · 16/11/2024 00:30

Sorry to hear this OP. Who is your management company? Some of them are utter scammers, but absolutely ruthless when it comes to receiving the money they claim is owed to them, like FirstPort for instance.

Another poster mentioned moving to RTM, I would strongly advise you look into this if you can. It can be a lengthy process, but certainly worthwhile in the long-term.

Haveyouseenthischicken · 16/11/2024 00:31

@PeloMom we just aren’t sure what the end game for the management company really. The place will essentially become a ghost town as people will just sell up as fast as they can and as cheaply as they can by any means possible. No one will want to buy. It’s a disaster!

The government backed Leasehold Advisory Service will likely be more help than Shelter.

MatLeave · 16/11/2024 00:34

Is there any way you can set up a meeting with all of the owners to discuss this. Get a breakdown of all the factoring costs and take it from there. Get legal help if you can. So sorry this impacting in your life plans. Its a shame as it would have been a sound investment without all of the added service charges. I hope you are able to get it resolved.

Floralnomad · 16/11/2024 00:35

Can you try and speak to the MP who has the constituency , may not be any use but some of them are willing to try and assist with these kinds of things . Obviously these management groups need regulating as it’s ridiculous .

ultraviolet4753 · 16/11/2024 00:45

Does your home insurance have legal cover maybe? Can hopefully get advice along with Shelter

twilightermummy · 16/11/2024 00:52

How can they justify doubling it? It's disgusting. I understand why you're stressed. I think it would be helpful for you to try and take a break away from all of this, if even just for a few days. You could download a meditation app and just try and zone out of it for a small while. This must be absolutely wearing you down.

Residents/owners should team together and get legal advice

Managing agents charging extortionate fees should be the next financial scandal to be tackled! Lets hope it is, but I can't see that it will be...
Look into right to manage.
