DBS - this came up in a GG thread but wasn't discussed.

How would a DBS check be carried out if you can't deadname a trans person?

Fro what I can see, it is up to the trans person to contact the authorities to fill in a special form. The new employer won't get to know their "dead name"

I can see no problems with that at all, after all, if you have something to hide you are absolutely going to
do this, aren't you?

I can't remember the process when I last applied for my DBS but, as anyone can change their name, I am assuming that there is a mechanism for dealing with this included within the process.

You have to supply several different forms of ID and at least a passport or birth certificate so I presume that a change of name will be apparent.

If it isn't, then that is a risk for anyone completing a DBS and not just in the case of self ID.

What stops any criminal from simply changing their name and then applying for a DBS and so erasing their past?

I understand that there is some campaign underway to delete any criminal record for trans gender people but I cannot see that being allowed so, at least for the time being, the DBS system is as robust for a trans gender person as it is for anyone else.

I think people misunderstand this a bit.

The DBS check should take in all previous identities. If the trans person does not want their employer to know their previous identity, they can use a special phone line so that the employer receives all the relevant info but only in the new identity. If they don't care, then they don't use the phone line and the DBS will come back using the old and new identities.

That said, the system generally isn't perfect and I think should be regularly reviewed with an eye to improvement.

How would this work if say there was a rape conviction and only men can be convicted of rape, but the applicant is now a 'woman'?

The DBS check comes back with all the info in both cases. Just using the sensitive cases phone line in only one name.

But if you get a GRC then presumably your birth certificate is changed to your new name? How exactly, in the absence of the transgender person phoning up the confidential hotline, can it be checked. And if can can be checked without that person phoning up, why get them to?

This is a question I have not yet seen the answer to.
