I don't get why you're still asking?

You could have a second property with tax credits, you could have let anyone live there and you didn't have to charge rent.

There is no notional income, you've done nothing wrong. The rules are different for uc but obviously that doesn't apply.

Saying that you could have charged rent is irrelevant for tax credits. They didn't work like that.

@Dasch I really wouldn't worry, in the screenshot you added, none apply to you.

You haven't deprived yourself of funds. Not charging rent is completely within the rules of tax credits.

Tax credits have completely finished now afaik but you wouldn't have anything to declare anyway.

It’s just all confusing child and working tax credits just say any income you have received from property which I haven’t received any they don’t even say you need to tell them of any property when I’ve looked so how are you supposed to know this 🙈

Because tax credits were based on income and not assets. You could have 15 properties with tax credits and if you weren't earning an income from them they would be disregarded (not agreeing with it but saying how it was)

Op that looks like some kind of ai that's cobbled together rules from uc and applied to tc.

The only way you're going to know and move past this is if you ask hmrc. Iirc property didn't have to be declared for tc but does for uc so there would have been no way of informing them at the time.

You could ask chat gpt or similar to write a letter for you to enquire.

I think my son doing a bank loan for 40000t to pay off rest off the mortgage would be seen as rental income and avoiding paying taxes 🙈

Did he pay directly to the mortgage company or give you the money? I can't see that it would be classed as rent or income as it was paying off a debt (which was allowed). Who has suggested that it's income?

I don't think anyone is going to be able to tell you - it's a very niche situation. It would need someone with specialist legal knowledge of the system to advise you.

You could:

  • contact whoever administered tax credits and advise them and they can decide. (I can't remember which government department was responsible)
  • get legal advice on whether it would have affected your benefits (although if you are going to notify tax credits if you are liable, you might as well save yourself this money and go to them direct).
  • as tax credits no longer operate, it's unlikely anything is going to happen, so you could just leave it and hope for the best. You would have to live with any anxiety you might have about this coming up in the future, and the risk of action against you if it did turn out to be fraudulent.
