Is this solicitor blackmailing me?

I don't mean to be dramatic but I think I'm being blackmailed by a solicitor?

I can't give too many details so apologies for being brief - a media agency stole my intellectual property and put it behind their paywall (they're a subscription based service). After being completely stonewalled, I instructed a lawyer to help me take them to the small claims court. Agency's lawyer is massively rude in all his correspondence calling me money grabbing and shameless among other things. Here's where he really crosses a line - he says my "shameless and appalling conduct in this matter would make for a very interesting news story which would come with a suitably garish headline (proceeds to invent a disgusting headline about me)". Remember, he's representing a huge media agency so it's entirely possible.

So if I proceed, this solicitor/the company he represents are going to write a smear campaign against me. If I drop the legal action, my (and my business's) reputation will remain undamaged. Surely this crosses a professional conduct line? I've asked my lawyer but I'm still waiting on a reply. I'm terrified; I'm a mum of two who relies solely on the income of my small business and all I've done is try and protect my intellectual property from copyright theft which is my legal right. I'm scared to go ahead with the small claims court action and I'm even too scared to leave the house just incase they've planted a sneaky photographer out there to get pictures for their hit piece article.

Coercion, blackmail, threat - whatever this is - are they allowed to do this?

I’m guessing he’s an in house lawyer rather than working for an external firm?

Definitely report to the SRA.

It may be purely intimidation tactics - a lawyer won’t be responsible for editorial decisions. Although the firm may have a general MO of bullying individuals/small companies over copyright. It’s very stressful for you but a squabble over intellectual property rights is no way “a very interesting news story”.

Is your solicitor a media lawyer?

I think the media would be far more interested in a large corporate stealing a self employed mum of two intellectual property, and then using intimidation tactics when they're called out on it, than they would be in you potentially being 'money grabbing'.

Don't let the bullies scare you. They're in the wrong here, not you.

Do you have this in writing op? Fucking stupid of them if so.

What exactly do they have on you to blackmail you with though? Are you locally famous enough that anyone would even be interested in rumours about you? Are you more concerned about the reputation of the business??

I suspect if he was going to engineer a campaign against you he wouldn't have told you he was going to do it. It should like big words from someone who knows their don't have a leg to stand on, trying to scare you but unfair shit happens so very sensible of you to consult a solicitor.

I don't think it amounts to blackmail hut I'd definitely put in a complaint to the SRA.

Get everything in writing and if they try to threaten you again say that you will counter sue.
