My job offer within the nhs has been rescinded after my previous manager disclosed my BiPolar

2024 I was off work because I needed my medication increased. If you have bipolar you understand. I was off for 8 weeks whilst I got over the extra sleepiness. I returned to work and my managers manager did the return to work, wherein this meeting she wrote down everything I said in a personal notebook. She specially asked my what my mental health medication was and wrote it down. I asked why and she said she wanted to know if ‘it was safe for me to be at work’ then she laughed and said ‘ha I mean am I even safe right now the door is closed,
you’re not going to go psycho on me are you?’

I immediately started a grievance that obviously they found unfounded because it was my fault led against
hers. This year has been hell.

Recently I applied for a new job in a different trust and it was all going brilliantly until after the reference from my previous manager. Job offer removed . Subject access requested immediately. 1 month later (ish) I got a massive tranche of emails and I got my reference which was actually fine.

The issue is my current manager then emailed the new manager and said and I quote ‘she does have BiPolar and she quite worryingly is on an antipsychotic for it as well as antidepressants. My manager had a conversation with her in a closed room and was very concerned bc she might lose it. You never know what people with this kind of disorder are capable of do you? My advice would be to rescind the offer because she was also off for a fair bit of time for ‘medication titration” whatever that is’, I also didn’t believe she even had it at the beginning so I contacted her GP directly to challenge whether the sick note we received was even legitimate but it was’. 4 days after this email was sent (Easter ) I was informed my job had been rescinded

At this poInt I’m beyond angry. I knew she had spoken to my GP because they rang me (the Gp) to say that 24 hours after receiving a letter from her regarding the authenticity of the fit note she rang them pretending to be me and got the security question wrong.

This isn’t normal is it ? Can I add this to my grievance or do I just resign and take it all to tribunal ?

I was not clinical facing from 2023 up until now (well who knows)!! However my next post was essentially my pre surgery role high up in Pathology if that changes anything

This is the nhs. I was moved non clinical during cancer treatment and I’m now applying for clinical positions to resume my original Job.

It’s genuinely making me reconsider working for any nhs trust but then what do I do with my specialism 🤦‍♀️ it’s so hard

This is awful OP, as well as discrimination it also sounds like bullying and harassment to me - your manager seems to be weirdly fixated on you and actively trying to sabotage you. I really hope you get the support you need and are able to move on from this toxic environment.

For what it's worth, I'm a manager and would not have any qualms with having someone like you as a report - just wanted to give you hope that it won't always be like this and not every manager is a dickhead/moron!

This is so utterly shocking that I’m struggling to believe that it’s real, sorry OP. The NHS absolutely can be toxic but this is completely beyond anything I’ve heard or experienced before.

There’s so many nasty people working in the NHS and a lot are in leadership management roles. Get some free legal advice to see if you definitely have a case and take it to a tribunal. Good luck.

Jesus h Christ, this is awful. I’m bipolar and spent 4/5 years on the max dose of quetiapine. I feel your pain and honestly I think I’d been contacting your union rep AND stating employment lawyers. This is awful. Upper manager claimed to be you to access your private medical records and they work for the NHS? That is shockingly bad, you can’t/shouldn’t just access perked records to satisfy your own curiosity!!! And that’s before the hideously uneducated comments about being psychotic.

i don’t know hope it works not because this information backs up your original grievance claim, does that mean you can re complain with this new proof? Or would it just be one new complaint with asking for that to be reconsidered?

either way, o hope your manager gets sacked and you get a big fat payout. This is completely unacceptable

I have nothing to add apart from echoing that you should get a lawyer and contact your union - but this is truly shocking. I hope you know that there is no question you’ve been treated appallingly here - don’t underplay it to yourself. I would take this as far as you can, and I am so sorry this happened to you. 💐

I’m so sorry OP, I’m actually disgusted in your treatment at work.

As others have said, I would take it external and get legal advice for discrimination in addition to your grievance.

Sue the NHS for disability discrimination. There are a couple of legal charities you can support with but start with your union.

follow up on the grievance for current role and manager. The only good outcome is sacking her. She has behaved disgustingly.

It was an email and she made a subject access request. You are entitled to emails that are about you between organisations.

I was a union rep in a government department, and dealt with a similar case. My case had her grievance upheld, and it was clearly disability discrimination. It’s now going to an employment tribunal and her solicitor thinks she will win.

Please get your union rep involved and also contact ACAS ASAP as you need to get in an ET case quickly. If the union solicitors won’t take it on (and they should) then see if you have free legal cover with your house insurance.

There are 2 clear courses of action you need to take here op. One is adding to your grievance against your line manager.

the second is a formal complaint for disability discrimination against the other trust who rescinded the job offer.

definitely talk to your union / seek legal advice about how to proceed with both.

I’m so sorry for you, it’s outrageous.

How did you find out the exact words of a private conversation?

I did a subject access request, requesting to see all emails that refer to me by name or initials between basically all the staff in my department and my new manager between a set of dates, and as you are entitled to all data held by your employer about you they have no option but to disclose it. It took ages but I got them
