A woman has been found guilty of raping two women when she was a man. Happened in Scotland. She hasn’t been sentenced yet - but where will she serve her sentence? In the womens prison?!
This is going to mean some serious discussions and tough times for the Scottish government. But it was surely only a matter of time before something like this happened.

Men have no right of access to women as therapeutic resources.

On a specialist TQ+ wing there will be plenty of people with all genders to socialise with.

In fact if we're going to look through that particular hand of ideological cards, the male prisons will in fact be full of all genders and no one can tell they're male without chromosome checks, can they now? So what's the diff? The risk assessments will work just as well there to keep vulnerable TQ+ male people safe presumably as the risk assessments supposed to keep vulnerable female people safe from the sex offender among them?

If we end up with separate units for "transwomen" it'll be interesting to see the reaction. I can imagine howls of outrage from some of them. Claims that they're not safe because some of those "transwomen" are dangerous. They'll not see the irony.

They've done it before. Not sure if it's still in use. Usual thing - space and resources taken from the female prison estate, not the male, because of the need for high risk transwomen to socialise with female prisoners -

I have the tiniest bit of sympathy for Paulette (and I do mean tiny). It was an awful answer which made her look clueless with more empathy for a rapist than his victims. But I think that is a result of the Labour Party having no clear and sensible position, so less experienced MPs who aren't used to bullshitting are coming really unstuck.

Elizabeth Fry - the Quaker reformer who campaigned and fought for separate prison facilities for women to prevent them being assaulted and exploited.

Thanks I'd never heard of her.
I'm away to look her up. Feeling almost ashamed not to know about the many amazing women who've gone before us and who make the place a better place for us.

Its verging on crazy that Transwomen wouldn't want to consider being women if we didn't have the same rights as men folk.

The idea used to be, do something bad enough to get sent to prison, and you lose some of your rights. How old-fashioned! Nowadays, if you're a member of a Select Special Group of people, you actually get some additional rights, like your hurty feelings being taken into consideration, and, best of all, choose your own nick! 😃

When you look at the SPS’s description of the “comprehensive” risk assessment they carry out, you soon see where the focus is (emphasis mine):

“Factors that we consider are the identified gender of the individual, how they were living in the community, where the individual themselves want to be placed. We will also consider their criminal history, so that will look at their index offence, their previous convictions, and we will take into consideration any risk factors that may pose a threat to individuals of a particular gender

“We will also consider the mental health of the individual and if their mental health may be exasperated, or negatively impacted on if placed within a particular area, and we’ll also consider the safety of the individual themselves – have they been the subject of any gender-based violence?“

So… that’s 7 areas that relate to pandering to the prisoner’s circumstances and just two (past offending and risk factors that pose a threat) relating to impact on the female estate.

No wonder the SNP are happy to rely on the SPS’s judgement about what to do with violent male prisoners wanting entry into female prisons.

Showing that, contrary to what some politicians have been arguing in favour of making GRCs easy to get, having a GRC does make a difference to more that a birth certificate or marriage licence.

That Scottish Minister who has such faith in the Scottish Prison Service. The SPS who has put a rapist in a women's prison, that SPS. He's in isolation at the moment but, according to the above article, he will have to be released into general circulation, with the women, in 72 hours. Actually, less than 72 hours because, I assume, the clock started ticking when he was sent down.

There is some fuzziness in today's change to the transgender prisoner policy framework. The statement says that a) more than 90% of "transgender women" in prison are housed in men’s prisons; b) there is no obligation to move transgender prisoners according to their wishes; and c) TW without a GRC are initially sent to a male prison as a matter of course.

Is a) just a consequence of the fact that more than 90% of TW don't have a GRC? Does b) mean that there's no obligation to house TW with GRCs in the female estate? In countries like Ireland with self-id where GRCs are easily available to any man, it appears that the state is obliged to house all TW offenders in the female estate because they are "legally female".

Do we know whether TW with GRCs are included in these stats? I know in other circs they're counted/recorded as female and so their impact "disappears" from the records.

I was musing on this while listening to Nicola Sturgeon on the radio seeming to imply that Bryson was "at it" (no true trans? But... doesn't that never happen?). She also said that GRR would have no impact on this sort of thing, but if TW with GRCs do disappear from stats it will certainly muddy the waters nicely to hugely increase their numbers.

I don't think there should be exceptional circumstances either, but it might have been politically necessary to get this agreed.

Whilst I don't agree they belong in the women's estate, it's possible they were thinking of someone along the lines of a non violent, GRC holding late teen TW, who has been on puberty blockers and has had breast implants but hasn't yet had so-called bottom surgery. So potentially someone who is small, highly feminised (for a male), functionally infertile, maybe even with micro penis.

I don't think that individual belongs in the female estate, but the risk to them in the male would be exceptionally high. They are the sort of sympathetic case which many still imagine and I could see a scenario where that kind of individual was being repeatedly presented as a reason not to block TW, and someone has proposed the "exceptional circumstances" ministerial approval to get around it. Which I can see the logic for as we know that the number of these individuals is tiny, comparatively.

I might be giving them too much credit mind you!

It's not perfect but, for rUK, it's a big step forward.
