Nightmare proposed trans policy at work

GCWorkNightmare · 14/11/2022 08:48

Work are consulting on a new trans and non-binary support policy. Policy states that trans people have the right to use whichever toilets and changing rooms they like and that anyone objecting should be educated and offered to use different facilities if they still object. When I queried it I was told that the Landrover case confirmed this as law.

Pointed out that this discriminated against women of some religions, victims of VAWG etc but they’re holding firm.

Can anyone give me info/links to refute this?

They also want a category of special leave without limits for trans people.

We are a National non-unionised company.

Is your place of work something involving children OP?

Adults and children, yes.

Ask them how they feel about doing a staff fundraiser for Mermaids....

I don’t know whether to watch and wait for something to happen or to leave. :(
If you are thinking of leaving then make sure that you get them to put this stuff in writing. Makes it easier to sue them.

Manderleyagain · 07/12/2022 15:18

They’ve answered my safeguarding concerns by pointing to the policy that lets trans children sleep in accommodation with whichever
sex they like.

Is this their own policy, or from a different organisation?

I think their response shows that we are still unfortunately at the stage where it's best not to point directly to sex matters & similar orgs if possible, but mine their info for other resources. I know that's a bit unfair on them but I think that's where we are with orgs who are fully paid up members of the black-and-white-thinking club.

The liberal democrats had a trans policy & definition of transphobia. A group of lib dems bought a legal opinion by a specialist KC which said the policy was unlawful and opened them up to the risk of legal action. The party then bought its own independent opinion by a different kc which I presume they hoped would say the first one was wrong. It didn't. It went even further than the first one. They had to change the policy. It wasn't about loos & leave and things but I think the same principle applies. If an alternative legal opinion could be sought it would at least show the legal department they are on a sticky wicket. I don't know if that's feasible, possible, desirable. Certainly very difficult to do as an employee.

ResisterRex · 07/12/2022 15:01

*They’ve doubled down. Added lines about Equality Act entitlements to use single sex facilities if you’re trans/non-binary. And put it out for wider consultation.

I agree with nilsmouse and based on the above, I would escalate to your MP at least. Child safety is at risk.

Safe Schools Alliance or Transgender Trend might be other options.

nilsmousehammer · 07/12/2022 14:54

I would pass this to Sex Matters and the EHRC at this point.

Ask them, what are you supposed to do now?

And then ask your MP, do I have equality of rights in law in the UK or not?

GCWorkNightmare · 07/12/2022 14:37

So, I really tried. Sent them links to EHRC and sex-matters - was told the latter was anti-trans and so not impartial, unlike Stonewall (who they have membership with and sought guidance from).

Mentioned specific cases, guided them away from Landrover and towards Maya etc.

covered all the points, basically.

The person writing it has a trans child (FTM) and the EDI lead “isn’t well versed” in this. They’ve run it past our corporate lawyers (who aren’t employment law experts) who think it’s all fine and dandy, apparently.

I don’t know whether to watch and wait for something to happen or to leave. :(

I'm resigned to the probability at some point I'll have to identify as trans to avoid accepting the "womany mind" identity.

Trans what I'm not sure of. Possibly I'll need to coin another neo-gender. However I'm 100% certain that I can't honestly claim to be a woman in an org that understands that to mean "womany minded person of either sex".

This is not piss taking. I genuinely can't accept that identity. I'm very close to resigning from a woman's network exactly because it's open to "anyone who identifies as a woman" and if I'm honest I don't, or rather the meaning of "women" I identify as is not the meaning of "woman" they use so I feel dishonest claiming I do.

This is the thing that the gender ideologists ignore. They redefine womanhood to accomodate male bodied people, but there's also an unspoken assumption that us old school female women will just keep womanning the same as ever, keeping the female estate that trans women so desire intact for them to appropriate.

But it doesn't work like that. The very change they need to make to get themselves also changes womanhood for us as well, and many of us may no longer feel we qualify.

This will be an interesting development because I am one of the most senior "women" in my department and get asked to figurehead a lot of things (I'm not very senior but my dept has a woman problem).

If I do find I have no option other than taking that route, I'm looking forward to establishing the ABFAB (agender but female at birth) network to celebrate ABFAB people's achievements, highlight the history of ABFAB oppression by the MAB and the unconscious bias we still face, and lobby for ABFAB-only spaces and support.

AFABTW or trans trans woman

There's a thread somewhere that demonstrates that at least one Council - Bristol City Council - says that you are agender (and trans) if you "are genderless or who reject gender identification completely."

I do feel the same as you. If people are insistent on changing the meaning of words (but not defining them) then there is only so long until you can't make yourself understood without adopting that terminology. I don't think it will come to that any time soon - most people will simply be unable to understand that 'woman' does not, and never has, meant 'female', and for the first time in a long time I feel optimistic that the tide is turning.

ThereIbledit · 15/11/2022 00:39

I'm not quite ready to give up the biological definition of woman just yet, but I don't half fancy being an ABFAB!

What a great post @FlirtsWithRhinos - ABFAB? Superb.

EpicChaos · 15/11/2022 00:06

Show your boss a vid of attempts by women to talk at a womans event in New York, as per the appropriate thread, and ask them why they think women should be subjected to that treatment!

This is so well put. I, btw, no longer consider myself a woman because people think it is an identity statement and I do not identify as a woman. I'm only one if that's what we call people who have my body parts. If Eddie is a woman, then clearly it's not about having my body parts and there is no reason left to say I am a woman. This will make TW sad because it exposes them to the reality of the fact that they are not like me. They need me to identify as a woman so they can say they are like me. I feel for them but it is not my job to protect them from whatever issues they have.

QuebecBagnet · 14/11/2022 21:28

I’ve been Googling about all the new genders and really like this one:

Busygender: for when you’re being too busy to have a gender

too bloody right, too old and too busy for half this shit!

Very much that. Whatever this group has become, like LGBT+, it no longer is a group I belong to or speaks for me, or one I feel any qualifying factors for or connection with. I wonder what all of us disenfranchised people will identify as?

Special leave without limits? How will they check that the people applying for this are "really trans"?

I'd be ID-ing as trans in a heartbeat over this. Blue hair and no other changes (to be fair the blue hair is options).

I note the assumption that the transgender employee will be a transwoman seeking to use the female facilities, rather than a transman stripping naked in the gents changing rooms.
