I too don’t think this should be a ministerial decision as a future labour government could have no issues with saying yes and this shouldn’t be an issue that changes every four years. It should be a blanket no imo. A separate prison could work.
politicising this means it’ll just be fought over continually and a culture war talking point. It shouldn’t be, it should just be a clear policy not one that changes with each change of government or even within the same government with reshuffle.

I agree a blanket ban on any and all male prisoners even those with a GRC from being placed in the female prison estate, no ifs, buts, maybes just a flat out NO. Separate wing(s) or buildings within the male prison estate is where they should go.

However, putting it the way Raab has whereby a named Government Minister has to personally sign it off, put their name to it publicly and justify it to the public could be a step that works. Ministers of whatever Party that is in Government are also MP's and would have to face their own constituents and the electorate at large and explain and justify why they did so, especially if the prisoner then went on to assault females within the female prison estate - I seriously can't imagine any of them willing to do that. The MSM would be like a dog with a bone about it too.

BellaAmorosa · 07/08/2022 22:10

And let's not forget that over 90% of male trans prisoners are accommodated in the male estate without problems - revealed in the recent HoL debate. So there was no need for a single male to have been transferred to women's prisons in the first place. GRC or not.

I completely agree @sashagabadon.

Respect away. Salute them, gold plate the facilities, drape the place with Pride Flags, gronda to the bloody aspidistra by all means. Just don't lock them in enclosed spaces with non consenting females. I'm positive that can be respectfully avoided.

Of course we have to treat transgender prisoners with respect,

Why is this nonsense line always parroted? Are they saying only trans prisoners should be treated with respect? What about other prisoners? Either treat all prisoners with respect or none of them, stop singling out one particular type of prisoner for respect.

This kind of thing is said by the type of person that at some point probably didn't treat trans people with respect, and is now having to make a point of doing so.

Teamsaction · 07/08/2022 19:27

This is the issue I feel most strongly about and the press rarely talk about it, it's an abomination that a male penis could rape and then be placed with vulnerable females. In America where children are been fathered, where is the safe guarding? It's madness.

Artichokeleaves · 07/08/2022 19:01

Of course we have to treat transgender prisoners with respect,

'Respect' does not include 'right of access to non consenting vulnerable females' ffs.

It is perfectly possible to treat TQ+ male prisoners with respect without treating female prisoners as a resource those male prisoners have an entitlement to.

It would be nice if 'respect' was actually a form of treatment aspired to by government ministers in the treatment of female prisoners too. Because currently male people: the issue they want help with is limiting their freedom of choice and placing boundaries on the exercising of their chosen gender identity. Female people? They'd just like to not be forcibly subjected to being intimidated and assaulted by male prisoners please.

Freedom of self actualisation vs not being raped. Seriously. And in considering whether we perhaps ought to not let those women get raped, we have to wring our hands about whether protecting them disrespects male prisoners?

At what point is this screaming binary sexism going to dawn on these supposedly intelligent people? This is sex based thinking. Binary sex based thinking. No one anywhere in this situation believes these male people are women. Women don't get this kind of consideration!

Treaclemine · 07/08/2022 08:46

So if it could be challenged as an issue for the human rights of the trans, why cannot the human rights of the women be a counter issue? After all the women are supposedly human, aren't they?

Agree

But does anyone know more about this?

In what way can it be challenged and by whom

GrimDamnFanjo · 07/08/2022 17:13

Does anyone know how many trans women are in the female estate?

ResisterRex · 07/08/2022 17:05

@TooBigForMyBoots this is what the article said:

"Mr Raab plans to implement a new policy whereby Ministers have to sign off any move of a male-bodied inmate to a women’s prison even if they self-identify as a woman."

They will be directly linked to the decision.

If a future decision is made to house males with females, that politician will have to own it.

Think you're being a wee bit optimistic there @ResisterRex. Politicians rarely own any of their fuck ups. I'd like the politicians responsible for the housing of over 40 male bodied folk in women's prisons today, own it.Angry

achillestoes · 06/08/2022 20:07

Lisa Nandy will be having kittens.

😂

ResisterRex · 07/08/2022 16:39

I agree it shouldn't be a minister. It should be plain common sense and in straightforward policy.

However, as we will have a change in political majority at some time, going this route means whoever is going to have to make the decision cannot duck it. There's no hiding behind excuses. If a future decision is made to house males with females, that politician will have to own it.

Given the radio silence from the Labour frontbench on recent other developments (GIDS), I wonder if they would do it. I wonder if anyone would have this squarely at their door.

Getting the law changed is vital on this issue. Currently it is lawful to house males in the female estate, which is grossly unfair to women. Even the female prisoner who bought a case against the government was told it was legal, though perhaps not desirable. I hope we end up in a position where womens prisons are truly single sex, no males no matter what surgeries they’ve had done, hormones they’re taking etc.

This is the crux of the problem with the EA2010, excellent piece of legislation in many ways, that discrimination on the grounds of sex is lawful in certain circumstances but not mandatory. That's why the MoJ policy is lawful - they may discriminate but they don't have to.

As the government have presided over this shit show, unravelling the harm seems the least Raab can do.

Yep.

BellaAmorosa · 07/08/2022 16:34

aweegc · 07/08/2022 03:45

This decision shouldn't be made by a minister because that makes women's single sex prison space a political issue. So it would remain single sex under a Tory government (for the moment) and be a free for all under a Labour govt.

A separate area with guards who are trained in whatever issues are relevant to that prison population should be established. It could be a world leader in terms of treating trans prisoners with dignity and conducting research into that groups recidivism rates, violence or self harm rates etc - whatever is studied in other prison groups - so that issues specific that population in prison can be addressed. It could be very beneficial to trans prisoners, instead of their issues being enveloped within other groups.

And it would not be contained on any part of the women's estate. If it's within an established prison it should be part of the male estate.

Yes!

achillestoes · 07/08/2022 14:34

Yes, I want someone to ask Nandy this in every interview. She’s a possible Home Secretary. We need to know this.

I'd bloody love some journalist to do their job and say yes, you have one trans constituent. But you want to run the whole country so what about the 51% of the population?

Of course no journalist ever puts the tough question as to why Nandy's one trans constituent means that paedophile rapists should be placed in the female prison estate if they decide they are women.

It's high time journalists did their jobs and held people like Nandy to account for her utterances. The interview I'm talking about the interviewer didn't it was the usual crap.

VestofAbsurdity · 07/08/2022 14:17

I'll see if I can find it @achillestoes it was around the time of the GE 2019 I think, it was posted on here.

The backtrack was minimal Nandy segued immediately into her poor trans constituent waffle.

achillestoes · 07/08/2022 12:08

‘Nandy did back track a bit in an interview with someone (can't remember who) it was a one on one YouTube type thing’

Did she? In what way?
