"The Scottish Court of Session has ruled in favour of the Scottish Government in the judicial review of guidance to accompany "the sex question” in the 2022 Scottish census

We are disappointed with the judgment and will be requesting an urgent appeal"

So.
In Scotland the census allows you to make shit up.

Soooooo. Finding for womens services may well rocket because of all the ‘ladies’ registered? Interesting…

"Important to appreciate that this ruling turns on the construction of Census Act 1920 which unlike the Equality Act 2010 does not define “sex” nor confer individual rights. So imho the implications of last weeks ruling in @ForwomenScot case for self ID stand"

OhHolyJesus · 24/02/2022 11:36

This is shocking news, it splits Scotland from the rest of the U.K. for one - the data will no longer be unified and reliable but if this is what the SNP want to go down in history for then let it bite them in the arse at the voting booth.

It's depressing and worrying but we will keep going. I'm thinking of all the women in Scotland today Thanks and thanks to FPFW and FWS and all those fighting. We carry on, always.

TensionWheelsCooIHeels · 24/02/2022 11:33

MBM statement sums up the ramifications of this decision.

"... The ramifications of this judgement extend beyond Scotland’s census. It will cement Scottish Government guidance that advises public authorities to collect data that conflates sex and self-defined gender identity. It will impact on the ability of public authorities to meet their Public Sector Equality Duty requirements to monitor and assess policies in line with the protected characteristics.
And as we explained to the Cabinet Minister and Scottish Government officials, it means that the impact of gender recognition reform cannot be assessed. The Scottish Government was unable to respond to this point."

Odd to think that this was the land of the Enlightenment and reason.

Datun · 24/02/2022 11:29

Self identification of sex is not legal. I sincerely hope every woman in Scotland self identifies as a different sex, race, religion, income bracket, the lot.

Whereareyourshoes · 24/02/2022 11:20

Hugs to you @Chrysanthemum5

You are not alone in feeling sad.

A census based on lies. Pointless.

littlbrowndog · 24/02/2022 11:20

It is insane

Am going to write whatever I feel like on my form

That’s how it works isn’t it ?

FemaleAndLearning · 24/02/2022 11:20

Unbelievable.

ItsAllGoingToBeFine · 24/02/2022 11:19

FFS Angry Sad

I didn't want to have to register a protest via the census itself.

Rodedooda · 24/02/2022 11:18

I feel like I'm living in an alternate reality today.

This is insane.

Gumbomambo · 24/02/2022 11:14

Scotland are on a very slippery slope, this isn’t unexpected although incredibly upsetting for Scottish women. they are revelling in their rainbows but I think this will all come tumbling down. I noted many many voices raised in anger about the Scott’s being in the top 100 stonewall list. Just shit really for women and kids.

Imnobody4 · 24/02/2022 11:13

Sickening.

Chrysanthemum5 · 24/02/2022 11:09

Well I'm having a shit day and this has made it worse. Honestly could cry - Scotland is such a rotten place to be a woman.

They're waiting on the full judgement to consider what decision to make.

MummBRaaarrrTheEverLeaking · 24/02/2022 11:02

FPFW have tweeted. Appeal has been refused Angry

FemaleAndLearning · 24/02/2022 10:18

What time is the decision scheduled for today?

Fenlandia · 24/02/2022 09:56

So hoping this is a positive outcome for women. FPFW's carrot patch could do with a little tending too...

TensionWheelsCooIHeels · 23/02/2022 20:28

I've never wished I could be as wrong as I hope to be, given that my gut is telling me what the outcome will be. But I really hope I can come here tomorrow & say I absolutely called it wrong. I'll happily say I know feck all if FPFW get a result.

🤞🤞🤞

SunniDelite · 23/02/2022 20:02

If the judgement goes against us (women), perhaps we could get all our male allies to identify as women in the census? Get more provision for women? I'm not in Scotland, but have my fingers crossed for you....

Crikey that's fast. 😬

TensionWheelsCooIHeels · 23/02/2022 18:04

"Do you think they would be able to pursue an appeal even if it was too late for the census?"

They went ahead with the case Agatha ONS after the census opened - wasn't there something about the ONS actually bringing the date forward to try & out manoeuvre FPFW? There were trans people posting (and boasting) about completing the census before the judgement came in. So I'd say yes they could. But it'll come down to the judgement & reasons given for the decision, whatever it is. And FPFW's appetite to go further at more expense etc.

@Blessex

When are we expecting the judgement?
I think the Census opens on Monday so it'll have to be sharpish!
Manderleyagain · 23/02/2022 17:58

@nauticant

One important consideration in seeking leave to appeal to the Supreme Court is that even though a decision from that court would come too late for the Scottish Census, if the case stops at the Inner Court of Session with a confirmation that sex includes gender identity, then that's established case law in Scotland and to challenge that in the future would probably require taking a case through the High Court and Appeal Court levels to get to the Supreme Court.

Having got this far it would be worth pushing to the end, so long as there is confidence that the Supreme Court would view sex as meaning material reality rather than someone's self-perceived identity.

Do you think they would be able to pursue an appeal even if it was too late for the census?
